HomeMy WebLinkAbout2nd Qtr 2019 INDEX State Ethics Commission Quarterly Rulings for Second Quarter 2020 ADVICES (Ethics): 20-521 (Mahon): Re: Whether the Public Official and Employee Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq., would impose prohibitions or restrictions upon the Superintendent of the Abington Heights School District (“School District”) with regard to serving as a Member of the Board of Directors of the Northern Tier Industry and Education Consortium (“Consortium”), which receives compensation from the School District for providing services including workforce development opportunities for the School District’s students. 20-522: Re: Whether the Public Official and Employee Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq., would impose restrictions upon employment of the A of the B within the C following termination of Commonwealth employment. 20-523 (Picca): Re: Whether the Public Official and Employee Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq., would impose restrictions upon employment of an Assistant Highway District Engineer following termination of employment with the Pennsylvania Department of Transportation (“PennDOT”). 20-524 (Marlowe): Re: Whether, in your former capacity as a Bridge and Structural Drafter for the Pennsylvania Department of Transportation (“PennDOT”) under job code 10780, you would be considered a “public employee” subject to the Public Official and Employee Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq., and the Regulations of the State Ethics Commission, 51 Pa. Code § 11.1 et seq., such that the restrictions of Section 1103(g) of the Ethics Act would now be applicable to you. . 20-525 (Greiss): Re: Whether the Public Official and Employee Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq., would impose restrictions upon employment of an - 1 - Engineering, Scientific, and Technical Intern following termination of employment with the Pennsylvania Department of Transportation (“PennDOT”). 20-526 (Woods): Re: Whether the Public Official and Employee Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq., would impose requirements upon a Member of Council for the Town of McCandless (“Town”) with regard to disclosing her husband’s employment as the Vice President of Supply Chain Management for the Applied Products and Technology segment of Evoqua Water Technologies, where: (1) Evoqua Water Technologies makes products for wastewater treatment; (2) the McCandless Township Sanitary Authority provides wastewater services to the Town; and (3) Town Council appoints Members to the Board of the McCandless Township Sanitary Authority. 20-527 (Loperfito Toney): Re: Whether the Public Official and Employee Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq., would impose prohibitions or restrictions upon an individual serving as a Member of the Board of Directors of the Municipal Sanitary Authority of the City of New Kensington with regard to simultaneously serving as a Member of the Board of Directors of the Municipal Water Authority of the City of New Kensington. - 2 -
