Henry Nicholas A. Colafella Reverend Scott Pilarz 05 -060 Order No.1424 1/8/07 1/23/07 This is a final adjudication of the State Ethics Commission. Procedurally, the Investigative Division of the State Ethics Commission conducted an investigation regarding a possible violation of the Public Official and Employee Ethics Act ( "Ethics Act "), 65 Pa.C.S. § 1101 et seq., by the above -named Respondent. At the commencement of its investigation, the Investigative Division served upon Respondent written notice of the specific allegations. Upon completion of its investigation, the Investigative Division issued and served upon Respondent a Findings Report identified as an "Investigative Complaint." An Answer was filed and a hearing was requested. A Stipulation of Findings and a Consent Agreement waiving an evidentiary hearing were subsequently submitted by the parties to the Commission for consideration. The record is complete. The Stipulation of Findings is quoted as the Findings in this Order. The Consent Agreement has been approved. This adjudication of the State Ethics Commission is issued under the Ethics Act and will be made available as a public document thirty days after the mailing date noted above. However, reconsideration may be requested. Any reconsideration request must be received at this Commission within thirty days of the mailing date and must include a detailed explanation of the reasons as to why reconsideration should be granted in conformity with 51 Pa. Code § 21.29(b). A request for reconsideration will not affect the finality of this adjudication but will defer its public release pending action on the request by the Commission. The files in this case will remain confidential in accordance with the Ethics Act. Any person who violates such confidentiality commits a misdemeanor and, upon conviction, may be subject to a fine of not more than $1,000 or imprisonment for not more than one year. Confidentiality does not preclude discussing this case with an attorney at law. Green, 05 -060 Page 2 I. ALLEGATION: That Robert Green, a public official /public employee, in his capacity as Mayor of Jefferson Borough, York County, violated Sections 1103(a) and 1103(d) provisions of the State Ethics Act (Act 93 of 1998), 65 Pa.C.S. §§ 1103(a) and 1103(d) when he accepted fees as Mayor for performing wedding ceremonies which fees were beyond the compensation provided by law. II. FINDINGS: 1. Robert Green has served as Mayor of Jefferson Borough, York County, from January of 1994, to the present. 2. Green in his official capacity as mayor is authorized under Pennsylvania law to perform marriage ceremonies. a. Green is paid for this duty (and the aforementioned duties) via the annual compensation he receives authorized by Borough Code. 3. Borough Code, Section 1025, provides that the salary of a borough mayor shall be set by ordinance and shall not exceed, in boroughs with a population of less than 5,000, a maximum of $2,500 a year. a. The Borough of Jefferson has a total population of less than 5,000 people. 4. Green's W -2 Wage and Tax Statement forms reflect that he has received the following compensation from the borough for performing his duties as mayor annually: a. Year 2001 2002 2003 2004 2005 Annual Salary $1,500.00 $1,500.00 $1,375.00 $1,500.00 $1,500.00 5. Since September 1, 1996, Green in his official performing marriage ceremonies upon request. capacity as mayor has been Green has promoted himself as being the "Marrying Mayor of Jefferson." 6. Couples have requested Green perform their marriage ceremonies in any one of the following manners: a. Directly contacting Green in- person. b. Calling the borough office. c. Contacting Green on his personal cell phone and /or calling his home telephone number. d. E- mailing Green at his personal e-mail address, marryingmayor@aol.com. 7 When contacted, Green informs inquiring couples that he will officiate their marriage ceremony if he is available on the day and time they want to be married. a. Green informs the couples that there is no set charge /fee for performing the Green, 05 -060 Page 3 marriage ceremony. b. Mr. Green advises every inquiring couple that they may donate an amount they are comfortable in giving, but are not required to do so. c. If money is accepted by Green, he will inform the couple that he will use the money to cover his expenses and the remainder will be donated to charity. d. In those instances where a couple for which Mr. Green has officiated their marriage ceremony offers a donation, Mr. Green has accepted donations ranging from $10.00 to $300.00. e. Payments made to Green were both by cash and check. f. Green did not provide the couples any type of receipt if money was accepted from them. 8. The Borough Code, Section 1026 provides that any salary paid to a mayor, pursuant to an ordinance, shall be in lieu of all costs and fees collected by the mayor, [and that] all costs and fees collected by the mayor shall be turned into the borough treasury. a. Section 1026 further provides that any mayor shall elect to be paid by costs and fees or salary by the fixed ordinance. 9. Section 1029(3) of the Borough Code, Duties of the Mayor, provides that a mayor shall: "Keep correct accounts of all moneys received by him, to render to the council at least once a month an itemized statement of all such moneys so received since the last such statement, with the date at which and the purpose for which and the names of the persons from whom the same was received, and to pay all such moneys into the borough treasury, to report to the council from time to time on the state of the borough and to make recommendations to the council on matters of borough concern. The borough shall furnish the mayor with such books and forms as are necessary for the conduct of his office. Such books and forms shall be and remain the property of the borough and shall be surrendered to his successor in office." 10. Monies collected by Green for performing wedding ceremonies were not turned into the borough treasury from 2001 through 2005. 11. Funds received were deposited into a personal bank account at the Peoples Bank of Glen Rock controlled by Green and his wife. a. Green has also used this account to deposit funds not related to payments /donations received from newlyweds. 12. Not all cash payments received from newlyweds were deposited into this account by Green. a. Green used some cash payments to pay for expenses he incurred while traveling from one marriage ceremony to another. Green, 05 -060 Page 4 b. Green has performed up to 7 wedding ceremonies a day. c. Ceremonies conducted throughout a day were not always in close proximity of each other. d. When traveling to ceremonies, Green would use some of the funds received to pay for gas, tolls, parking, and food. 13. Green maintained business records detailing relevant information about wedding ceremonies he performed from 2001 through 2005 which included: a. The date of ceremony. b. Number of ceremonies he performed annually. c. The cumulative number of weddings Green has participated in since becoming Mayor. d. The county issuing the marriage license. e. The couple's marriage license number. f. The names of the bride and groom. g. Previous marital status of both parties. h. If either the bride or groom were previously married, did it end in divorce or as the result of death. The date in which the couple was valid to be married along with their actual wedding date. j. The number of days that transpired from the valid date to the wedding date. k. The day of the week which the couple was married along with the actual time of the wedding. The location of wedding including the municipality. m. How many miles Green traveled to perform the ceremony (to and from) along with Green's cost to travel to the ceremony. n. The amount of payment given to Green by the couple for performing the ceremony. o. Home address and telephone number of the couple. 14. Green's business records reflect that he performed 1090 wedding ceremonies from 2001 through 2005 and received the following payments each year: Year Number of Marriages Amount of Money Received 2001 244 $12,864.00 2002 207 $10,550.00 2003 231 $12,385.00 2004 201 $11,367.00 2005 207 $12,912.00 Total: 1090 $60,078.00 Green, 05 -060 Page 5 15. Of the 1090 marriages performed, 96 couples did not provide Green with any payment or donation. 16. Out of the 1090 marriages, 38 occurred at the Jefferson Borough building in the council chambers. 17. For wedding ceremonies Green performed outside the borough he would deduct a mileage reimbursement fee from any payment /donation received. a. Green used the mileage reimbursement rate determined by the IRS to calculate his financial reimbursement (number of miles X dollar rate = reimbursement). b. The mileage reimbursement rates Green used annually are as follows: Year 2001 $ 0.345 2002 $0.365 2003 $0.36 2004 $0.375 2005 $0.432 18. Green's claimed expenses for these items totaling $15,807 were as follows: * *[sic]. [See, Finding 32. Consistent with Finding 32, for 2001 -2005, the total of the claimed expenses for memberships was $3,507 and the total of the claimed expenses for advertisements, civil donations, memberships, memorials, and publications was $15,807.] 35. Subtracting the above amount ($15,807) from Green's total claimed expenses of $50,202 results in remaining expenses totaling $34,395. a. These expenses were for items such as mileage, supplies, office expenses, etc. b. These expenses were the type of expenses that would have been incurred by the borough and for which Green in his mayoral position could have been reimbursed. 36. The difference between the remaining expenses in Finding No. 35 above ($34,395), and the total received from performing the wedding ceremonies ($60,078) during the relevant time period (2001 -2005) equals $25,683. 37. At least $25,653 in income after expenses would have been received by the borough had Green turned over fees that he received from the performance of wedding ceremonies. a. Green did not transmit these funds to the borough. 38. The issue of Mayor Green accepting payments for performing wedding ceremonies was discussed and acted upon by Jefferson Borough Council in November 2005. 39. Minutes from Jefferson Borough Council['s] November 7, 2005, meeting include the following recorded discussion and official action taken to address the Mayor's receipt of "donations" for performing wedding ceremonies: a. At this meeting, Conrad Eiben made a motion for the Borough to set up a separate account as a Marriage Fund for which money would be received and donations received would be directed to charitable use and expenditures for the Mayor's expenses in performing these services would be reimbursed. Motion seconded by Sam Heltzel. Motion carried." 40. Since January 1, 2006, monies received by Green from performing wedding ceremonies have been turned into borough secretary /treasurer Dolores Barczak monthly to be deposited into a separate borough account specifically designated for wedding funds received. a. When submitting funds, Green will provide Councilman Conrad Eiben, a Green, 05 -060 Page 29 65 Pa.C.S. § 1103(a). member of the finance committee, a listing of marriages performed for the month, a list of expenses incurred and invoices /receipts to verify those expenses. b. Eiben will audit /review the expenses listed by Green and sign off on the expense list if approved. c. The expense sheets are then forwarded to the board for approval. d. To date, council has been approving the expenses that Green submits and issues checks to entities of Green's choice. III. DISCUSSION: At all times relevant to this matter, Respondent Robert Green (also referred to herein as "Respondent," "Respondent Green," or "Green ") has been a public official subject to the provisions of the Public Official and Employee Ethics Act ( "Ethics Act "), 65 Pa.C.S. § 1101 et seq. The allegation is that Green as Mayor of Jefferson Borough, York County, violated Sections 1103(a) and 1103(d) of the Ethics Act when he accepted fees as Mayor for performing wedding ceremonies, which fees were beyond the compensation provided by law. Pursuant to Section 1103(a) of the Ethics Act, a public official /public employee is prohibited from engaging in conduct that constitutes a conflict of interest: § 1103. Restricted activities (a) Conflict of interest. - -No public official or public employee shall engage in conduct that constitutes a conflict of interest. The Ethics Act defines the term "conflict" or "conflict of interest" as follows: § 1102. Definitions "Conflict" or "conflict of interest." Use by a public official or public employee of the authority of his office or employment or any confidential information received through his holding public office or employment for the private pecuniary benefit of himself, a member of his immediate family or a business with which he or a member of his immediate family is associated. The term does not include an action having a de minimis economic impact or which affects to the same degree a class consisting of the general public or a subclass consisting of an industry, occupation or other group which includes the public official or public employee, a member of his immediate family or a business with which he or a member of his immediate family is associated. 65 Pa.C.S. § 1102. Section 1103(a) of the Ethics Act prohibits a public official /public employee from using the authority of public office /employment or confidential information received by holding such a public position for the private pecuniary benefit of the public official /public Green, 05 -060 Page 30 employee himself, any member of his immediate family, or a business with which he or a member of his immediate family is associated. Section 1103(d) of the Ethics Act provides that no public official shall accept an honorarium: § 1103. Restricted activities. (d) Honorarium. - -No public official or public employee shall accept an honorarium. 65 Pa.C.S. § 1103(d). The Ethics Act defines the term "honorarium" as follows: § 1102. Definitions "Honorarium." Payment made in recognition of published works, appearances, speeches and presentations and which is not intended as consideration for the value of such services which are nonpublic occupational or professional in nature. The term does not include tokens presented or provided which are of de minimis economic impact. 65 Pa.C.S. § 1102. As noted above, the parties have submitted a Consent Agreement and Stipulation of Findings. The parties' Stipulated Findings are reproduced above as the Findings of this Commission. We shall now summarize the relevant facts as contained therein. Respondent Green has served as Mayor of Jefferson Borough ( "Borough "), York County, from January of 1994 to the present. In his official capacity as Borough Mayor, Green is authorized under Pennsylvania law to perform marriage ceremonies. See, 23 Pa.C.S. § 1503(a)(5). Green is paid for this duty, as well as for his other duties as Mayor, via the annual compensation he receives pursuant to Section 1025 of the Borough Code. See, 53 P.S. § 46025. Based upon the Borough's population, which is less than 5,000, Green's compensation is statutorily limited such that it may not exceed a maximum of $2,500 per year. Id. In 2001, 2002, 2004, and 2005, Green received compensation from the Borough in the amount of $1,500 per year. In 2003, Green received compensation from the Borough in the amount of $1,375. The Borough Code provides that any salary paid to a mayor pursuant to an ordinance shall be in lieu of all costs and fees collected by the mayor and that all costs and fees collected by the mayor shall be turned into the borough treasury. 53 P.S. § 46026. Additionally, a borough mayor is subject to the following statutory duty: § 46029. Duties of mayor It shall be the duty of the mayor: (3) To keep correct accounts of all moneys received by him, to render to the council at least once a month an itemized statement of all such moneys so received since the last such statement, with the date at which and the purpose for which and the names of the persons from whom the same was received, and to pay all such moneys into the borough Green, 05 -060 Page 31 treasury, ... . 53 P.S. § 46029(3). Since September 1, 1996, Green has performed marriages in his official capacity as Borough Mayor. Green has promoted himself as being the "Marrying Mayor of Jefferson." Green informs inquiring couples that there is no set charge /fee for performing the marriage ceremony. Green advises inquiring couples that they may donate an amount they are comfortable in giving, but that they are not required to do so. Green has received cash and check donations in amounts ranging from $10 to $300 for performing marriage ceremonies. Green has informed those couples making donations that he will use the money to cover his expenses and the remainder will be donated to charity. From 2001 through 2005, Green performed 1090 wedding ceremonies. During that same time period, Green received payments totaling $60,078 for performing wedding ceremonies. Green's business records reflect he reimbursed himself in the total amount of $15,980.12 for miles traveled for performing marriage ceremonies from 2001 through 2005. From 2001 through 2005, monies collected by Green for performing wedding ceremonies were not turned into the Borough treasury. Some of the funds Green received for performing wedding ceremonies were deposited into a personal bank account controlled by Green and his wife. Green has also used this account to deposit funds not related to payments /donations received from newlyweds. As detailed in Finding 21, between 2001 and 2005 Green made payments totaling $22,131.81 for personal items from the same account into which Green deposited payments received for performing wedding ceremonies. The parties have stipulated that such payments included certain checks totaling $7,000 used to purchase Prudential funds, which payments consisted in part of money Green received for performing marriage ceremonies. As detailed in Finding 29, between 2001 and 2005 Green made payments totaling $2,264.25 for various memberships using funds he received as a result of performing wedding ceremonies. As detailed in Finding 30, between 2001 and 2005 Green made payments totaling $10,055.33 for memorial and civil donation purposes. On Federal Income Tax Returns filed with the Internal Revenue Service for calendar years 2001 -2005, Green reported income totaling $60,078 received from performing wedding ceremonies, as well as expenses totaling $50,202. During the time period of 2001 through 2005, the difference between the total amount Green received for performing wedding ceremonies ($60,078) and the portion of the claimed expenses for which Green as Mayor could have been reimbursed by the Borough if the monies had been handled by the Borough ($34,395) was $25,683. Since January 1, 2006, monies received by Green from performing wedding ceremonies have been turned into the Borough Secretary /Treasurer on a monthly basis to be deposited into a new, separate Borough account specifically designated for wedding funds received. Green now submits supporting documentation as to the wedding ceremonies he performs and his related expenses. A finance committee member audits /reviews such supporting documentation, and Green's expense sheets are forwarded to Council for approval. Having highlighted the Stipulated Findings and issues before us, we shall now apply the Ethics Act to determine the proper disposition of this case. Green, 05 -060 Page 32 The parties' Consent Agreement sets forth a proposed resolution of the allegation as follows: 3. The Investigative Division will recommend the following in relation to the above allegations: a. That an unintentional violation of Section 1103(a) of the Public Official and Employee Ethics Law, 65 Pa.C.S. §1103(a) occurred in relation to Green accepting money for performing wedding ceremonies which were beyond the compensation provided by law. b. That an unintentional violation of Section 1103(d) of the Public Official and Employee Ethics Law, 65 Pa.C.S. §1103(d) occurred when Green accepted honoraria for performing wedding ceremonies as Mayor which fees were beyond the compensation provided by law. 4. Green agrees to make payment in the amount of $25,683 in settlement of this matter payable to Jefferson Borough and forwarded to the Pennsylvania State Ethics Commission within thirty (30) days of the issuance of the final adjudication in this matter. 5. The Investigative Division will recommend that the State Ethics Commission take no further action in this matter; and make no specific recommendations to any law enforcement or other authority to take action in this matter. Such, however, does not prohibit the Commission from initiating appropriate enforcement actions in the event of Respondent's failure to comply with this agreement or the Commission's order or cooperating with any other authority who may so choose to review this matter further. 6. Green agrees to waive his rights to an evidentiary hearing and appellate rights without prejudice to so proceed in the event that the State Ethics Commission does not accept this agreement. Consent Agreement, at 1 -2. In considering the Consent Agreement, we note that this case is similar to the Keller case decided by this Commission in 2003. See, Keller, Order 1282, aff'd., Keller v. State Ethics Commission, 860 A.2d 659 (Pa. Cmwlth. 2004). In the Keller case, a borough mayor had retained monies paid by couples for whom the mayor had performed marriage ceremonies. The mayor deposited such monies into a personal bank account and used the funds for donations to charitable /civic organizations. By law, the mayor was only entitled to receive his Borough salary. We determined that the monies the mayor had received for performing marriage ceremonies constituted additional compensation that was not authorized in law. Noting that the mayor deposited such payments into a personal bank account, made the decisions as to how the funds would be distributed, and also obtained political gain through favorable publicity he received as a result of charitable donations made using the funds, this Commission found that the mayor had violated Section 1103(a) of the Ethics Act. On appeal, our decision was affirmed by the Commonwealth Court of Pennsylvania. Keller v. State Ethics Commission, supra. Similarly, in the instant matter, it is clear that the elements for the recommended unintentional violation of Section 1103(a) have been established. There were uses of authority of office by Green. But for the fact that Green was Borough Mayor, he would not Green, 05 -060 Page 33 have been in a position to perform marriage ceremonies and to receive payments for doing so. See, Keller, supra. Further, the payments Green received for performing marriage ceremonies resulted in a private pecuniary benefit to Green consisting of unauthorized compensation beyond the annual salary Green was entitled to receive. See, 53 P.S. § 46025. As noted above, the Borough Code provides that any salary paid to a mayor pursuant to an ordinance shall be in lieu of all costs and fees collected by the mayor and that all costs and fees collected by the mayor shall be turned into the borough treasury. 53 P.S. § 46026; see also, 53 P.S. § 46029(3). Green did not turn over to the Borough treasury the payments he collected for performing marriage ceremonies as Borough Mayor. Rather, Green retained such payments, depositing some of them into a personal bank account controlled by Green and his wife. Green made the decisions as to how these funds would be distributed. During the time period of 2001 through 2005, the difference between the total amount Green received for performing wedding ceremonies ($60,078) and the portion of the claimed expenses for which Green as Mayor could have been reimbursed by the Borough if the monies had been handled by the Borough ($34,395) was $25,683. We determine that Green received a private pecuniary benefit in the amount of $25,683 when he retained payments that he received for performing wedding ceremonies as Borough Mayor during the time period from 2001 through 2005. Based upon the Stipulated Findings, it would appear that Green did not intend to violate the Ethics Act in taking the above actions. Although intent is not a requisite element for a violation of the Ethics Act, Yocabet v. State Ethics Commission, 531 A.2d 536 (Pa. Cmwlth. 1987), it is one of the factors that this Commission may consider in determining the proper disposition of a case. We conclude that the application of the law to the facts before us supports a finding that an unintentional violation of Section 1103(a) of the Ethics Act occurred in relation to Green accepting money for performing wedding ceremonies, which payments were beyond the compensation provided by law. See, Keller, supra. We shall now consider the parties' recommendation that we hold that an unintentional violation of Section 1103(d) of the Ethics Act occurred when Green accepted honoraria for performing wedding ceremonies as Mayor, which fees were beyond the compensation provided by law. A public official is prohibited from accepting honoraria, 65 Pa.C.S. § 1103(d), and to the extent honoraria are accepted, they constitute unauthorized compensation. In applying the statutory definition of "honorarium" to the payments in question, we conclude that the payments to Green for performing marriage ceremonies were payments made in recognition of appearances, speeches and /or presentations by Green made in his official capacity as Mayor. We note that the statutory definition of the term "honorarium" excludes "tokens presented or provided which are of de minimis economic impact." 65 Pa.C.S. § 1102. Factually, the parties have stipulated that from 2001 through 2005, Green received payments totaling $60,078 for performing wedding ceremonies. The individual payments, ranging from $10 to $300, were not large. However, given the significance of the payments as a whole; the fact that if Green had turned these monies over to the Borough treasury as he was required to do, the Borough's treasury would have been enriched by $25,683 (after expenses) (cf., Keller, supra); and the fact that the parties are in agreement that an unintentional violation of Section 1103(d) would be appropriate as part of an overall settlement of this case, we hold that an unintentional violation of Section 1103(d) of the Ethics Act occurred when Green accepted honoraria for performing wedding ceremonies as Mayor, which fees were beyond the compensation provided by law. We determine that the Consent Agreement submitted by the parties sets forth the proper disposition for this case, based upon our review as reflected in the above analysis and the totality of the facts and circumstances. Accordingly, Green is directed to make Green, 05 -060 Page 34 payment in the amount of $25,683 in settlement of this matter payable to Jefferson Borough and forwarded to this Commission by no later than the thirtieth (30) day after the mailing date of this Order. Compliance with the foregoing will result in the closing of this case with no further action by this Commission. Noncompliance will result in the institution of an order enforcement action. IV. CONCLUSIONS OF LAW: 1. Respondent Robert Green, as Mayor of Jefferson Borough, York County, from January of 1994 to the present, has at all times relevant to this matter been a public official subject to the provisions of the Public Official and Employee Ethics Act ( "Ethics Act "), 65 Pa.C.S. § 1101 et seq. 2. Green unintentionally violated Section 1103(a) of the Ethics Act in relation to his acceptance of money for performing wedding ceremonies, which payments were beyond the compensation provided by law. 3. Green unintentionally violated Section 1103(d) of the Ethics Act when he accepted honoraria for performing wedding ceremonies as Mayor, which fees were beyond the compensation provided by law.
