Colafella Reverend Scott Pilarz ORDER OF THE COMMISSION WHEREAS, on August 19, 2003, the Investigative Division initiated these proceedings by filing with the Legal Division a Petition for Civil Penalties; and WHEREAS, the Petition for Civil Penalties averred that as a Member of the Allegheny County Board of Assistance, Respondent failed to file a Statement of Financial Interests for calendar year 2001 as required; and WHEREAS, on June 30, 2004, the Investigative Division filed an Affidavit and Return of Service indicating that the aforesaid Petition for Civil Penalties had been served; and WHEREAS, on July 1, 2004, an Order to Show Cause was issued to Respondent, directing that she show cause why this Commission should not levy a civil penalty against her; and WHEREAS, Respondent did not file an Answer to the Order to Show Cause or request a hearing by the 30 -day deadline; and WHEREAS, on August 5, 2004, a letter was issued by Chief Counsel to Respondent indicating that Respondent was deemed to have admitted the averments of the Petition for Civil Penalties and to have waived a hearing; and WHEREAS, on September 20, 2004, this Commission decided this case; and WHEREAS, on October 1, 2004, this Commission issued Order No. 191 -S levying upon Respondent a civil penalty in the total amount of $250.00 and ordering Respondent to file a complete and accurate Statement of Financial Interests for calendar year 2001; and WHEREAS, on October 21, 2005, the Investigative Division filed a Motion to Vacate Order indicating that it had received new information confirming that Respondent had resigned from the Allegheny County Board of Assistance effective July 20, 1998. Paylor, 03 -031 -P Page 2 WHEREFORE, upon review, the following appears applicable: Having resigned from the Allegheny County Board of Assistance effective July 20, 1998, Respondent was not required to file a Statement of Financial Interests for calendar year 2001 with respect to such service. THEREFORE, based upon a review and analysis and after due consideration, it is ordered that: 1. The Investigative Division's Motion to Vacate Order is granted. 2. Order No. 191 -S is vacated. 3. Given that vacated Order No. 191 -S was previously released publicly, Commission staff is directed as follows: a. A notation shall be added on vacated Order No. 191 -S as it appears in this Commission's e- library and in the publicly available binders located in Commission offices, indicating that the Order has been vacated. b. An administrative notice shall be included in the next quarterly mailing apprising that Order No. 191 -S has been vacated and suggesting that the administrative notice be appended to any and all copies of it. c. As a public record, copies of this Order shall be available to any Pennsylvania resident requesting such in conformity with this Commission's Policies under the Pennsylvania Right -to -Know Act. Please attach this Administrative Notice to the copy of Paylor, Order 191 -S that you previously received from the Pennsylvania State Ethics Commission. If you have distributed any copies of the aforesaid Order, please provide copies of this Administrative Notice to all recipients for attachment to all such distributed copies.
