ADVICES (Ethics):
24-521 (Shields): Re: Whether, as an ex officio nonvoting Member of
the Indigent Defense Advisory Committee (“IDAC”)
within the Pennsylvania Commission on Crime and
Delinquency (“PCCD”), you are a “public official”
subject to the Public Official and Employee Ethics Act
(“Ethics Act”), 65 Pa.C.S. § 1101 et seq., and the
Regulations of the State Ethics Commission, 51 Pa.
Code § 11.1 et seq., and particularly, the
requirements for filing Statements of Financial
Interests.
24-522 (Barrett): Re: Whether, pursuant to Section 1103(a) of the
Public Official and Employee Ethics Act (“Ethics Act”),
65 Pa.C.S. § 1103(a), a School Director for the
Athens Area School District (“School District”) would
have a conflict of interest with regard to participating
in negotiations pertaining to a new labor contract
between the School District and the bargaining unit
for the School District’s teachers, where the sister of
the School Director is employed as a teacher with the
School District and is a member of the teachers’
bargaining unit.
24-523 (Peterson): Re: Whether the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq.,
would impose restrictions upon you with regard to
performing work for your new employer, Fairmount
Park Conservancy (“the Conservancy”), following
termination of your employment as the
Communications Director for the Office of the Mayor
(“the Mayor’s Office”) of the City of Philadelphia (“the
City”).
24-524 (Logsdon Kislan): Re: Whether, pursuant to Section 1103(a) of the
Public Official and Employee Ethics Act (“Ethics Act”),
65 Pa.C.S. § 1103(a), an individual serving as a
borough council member would have a conflict of
interest with regard to voting on matters pertaining to
an association that operates an emergency medical

service which provides services to the borough and
surrounding communities, where in a private capacity,
the individual is a member of the board of directors of
the association.
24-525 (Lawson): Re: Whether the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101, et seq.,
would impose prohibitions or restrictions upon an
individual serving as a member and chairman of a
municipal sewer authority that is constructing a new
wastewater treatment plant with regard to working
with the engineer in charge of the construction project
as a construction site inspector on the construction
project.
24-526 (kost): Re: Whether the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq.,
would impose restrictions upon you with regard to
working for the EADS Group, Inc. as a Construction
Inspector following termination of your employment as
a Transportation Construction Inspector Supervisor
with the Pennsylvania Department of Transportation
(“PennDOT”).
24-527: Re: Whether a member of a borough council, who
is employed with a \[Type of Political Subdivision\],
would have a conflict of interest pursuant to Section
1103(a) of the Public Official and Employee Ethics Act
(“Ethics Act”), 65 Pa.C.S. § 1103(a), with regard to
voting on the approval of a monthly bill list that would
include payments to the \[Type of Political
Subdivision\].
24-528 (Gilbride): Re: Whether a member of a city council, who owns
an HVAC company that is required to obtain permits
and licenses from the city in order to do business in
the city, would have a conflict of interest pursuant to
Section 1103(a) of the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1103(a), with
regard to participating in discussions or votes of city
council on matters involving the city licensing,
inspections and permitting department or on
legislation which may impact that department.
24-529 (Witt): Re: Whether a Supervisor for Tunkhannock
Township (“Township”), who in a private capacity is a
temporary part-time seasonal employee with Pocono
International Raceway, would have a conflict of

interest under Section 1103(a) of the Public Official
and Employee Ethics Act (“Ethics Act”), 65 Pa.C.S. §
1103(a), with regard to voting on matters involving
Pocono International Raceway.
24-530 (Sheehan West.): Re: Whether a school director for a school district
would have a conflict of interest pursuant to Section
1103(a) of the Public Official and Employee Ethics Act
(“Ethics Act”), 65 Pa.C.S. § 1103(a), with regard to
participating in discussions or votes of the school
district school board on awarding a contract for school
photography services, where: (1) the school director’s
sister-in-law, who is the sole proprietor of a
photography business, has submitted a proposal to
provide such services; (2) the school director is not
affiliated with her sister-in-law’s photography
business; and (3) the school director is in the process
of starting an unrelated photography business with
her sister-in-law that would not do any work for the
school district.
24-531 (DeVito): Re: Whether the post-termination of
service/employment restrictions of Section 1103(g) of
the Public Official and Employee Ethics Act (“Ethics
Act”), 65 Pa.C.S. § 1103(g), would prohibit an
individual serving as a township commissioner from
becoming employed as the township manager if the
individual would resign from the township board of
commissioners.
24-532 (Piepenburg): Re: Whether the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq.,
would impose restrictions upon you with regard to
performing work for an engineering and consulting
firm following termination of your employment as a
Transportation Construction Inspector with the
Pennsylvania Department of Transportation
(“PennDOT”).
24-533 (Green): Re: Whether an individual employed with the
Pennsylvania Department of Agriculture as a
Regional Program Outreach Coordinator would have
a conflict of interest under Section 1103(a) of the
Public Official and Employee Ethics Act (“Ethics Act”),
65 Pa.C.S. § 1103(a), with regard to performing the
duties of her public position, where: (1) the individual
and her husband are co-founders of an indoor urban
farm; (2) before the individual began employment with

the Commonwealth, the indoor urban farm secured a
$750,000 RACP award from the Commonwealth to
build a small facility in Chester County, Pennsylvania;
(3) the indoor urban farm is applying for funds from
the United States Department of Agriculture to match
the RACP award; (4) an award of federal funds may
include federal grants managed by the Pennsylvania
Department of Agriculture; and (5) the individual does
not oversee, manage, or advise on grant awards in
her role with the Pennsylvania Department of
Agriculture.
24-534 (Weist): Re: Whether either of two individuals serving as
township supervisors would have a conflict of interest
under Section 1103(a) of the Public Official and
Employee Ethics Act (“Ethics Act”), 65 Pa.C.S. §
1103(a), with regard to participating in matters
involving litigation between the township and a fire
company that was decertified as the township’s fire
service provider, where one of the individuals
(“Individual One”) is a member and vice president of
the fire company and the other individual (“Individual
Two”) is a member of the fire company.
24-535: (Carrera): Re: Whether the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq.,
would impose restrictions upon you with regard to
“representing” a “person” before the Pennsylvania
Department of Education following termination of your
employment as a Special Advisor to the Secretary of
Education for the Commonwealth of Pennsylvania
24-536 (Jumper): Re: Whether the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq.,
would impose prohibitions or restrictions upon a state
legislator in her capacity as a public official as a result
of the state legislator’s private activity as a co-owner
along with her husband of a company that provides
services to various municipalities, some of which may
be located in the senatorial district that the state
legislator represents.
24-537 (Bartulovich): Re: Whether, pursuant to Section 1103(a) of the
Public Official and Employee Ethics Act (“Ethics Act”),
65 Pa.C.S. § 1103(a), an individual serving as a
township supervisor would have a conflict of interest
with regard to participating in discussions or votes of
the township board of supervisors on matters

involving a youth soccer league, if the individual
would be appointed to the governing body of the
youth soccer league.
24-538 (Hanford): Re: Whether the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq.,
would prohibit an individual employed part-time with a
substitute teacher service that provides substitute
teachers to Central Dauphin School District from
serving as a School Director for Central Dauphin
School District.
24-539 (Repert): Re: Whether the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq.,
would impose any prohibitions or restrictions upon
you following termination of your employment as the
Deputy Secretary of Highway Administration for the
Pennsylvania Department of Transportation
(“PennDOT”).
24-540 (Giles): Re: Whether the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq.,
would impose any prohibitions, restrictions, or
financial disclosure requirements upon an individual
employed as a Principal Planner with the City of
Pittsburgh (“City”) with regard to accepting from a
conference host or sponsor: (1) a discounted or
waived conference registration fee for her attendance
at a conference; or (2) a scholarship to discount or
cover her travel costs for attending a conference.
24-541 (Carpenter): Re: Whether the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq.,
would impose restrictions upon you with regard to
providing services to the Pennsylvania Department of
Education (“Department of Education”) through a
vendor following termination of your employment as a
Database Administrator 2 for the General
Government IT Delivery Center under the Governor’s
Office of Administration (“Office of Administration”), in
which capacity you primarily provide server/database
support to the Department of Education.
24-542 (Barni): Re: Whether, pursuant to Section 1103(a) of the
Public Official and Employee Ethics Act (“Ethics Act”),
65 Pa.C.S. § 1103(a), an individual serving as a
township supervisor would have a conflict of interest
with regard to participating in discussions or votes of

the township board of supervisors on changes to the
township oil and gas ordinance, where the individual
receives royalties under leases involving producing
wells on approved well sites on property located in the
township.
24-543 (Mitchell): Re: Whether, in your capacity as an Electrical
Instructor with the Greene County Career and
Technology Center (“GCCTC”), you are a public
employee subject to the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq.,
and if so, whether there would be a waiting period
following your retirement from your employment with
GCCTC before you could be appointed to the GCCTC
Board of Directors.
24-544 (Snyder): Re: Whether the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq.,
would impose restrictions upon you following
termination of your employment as the Chief
Information Officer of the General Government
Delivery Center under the Governor’s Office of
Administration (“Office of Administration”).
24-545 : Re: Whether the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq.,
would impose restrictions upon you with regard to
performing work for a new employer following
termination of your employment as a \[Job Title\] with
the \[Commonwealth Department\], in which capacity
