HomeMy WebLinkAbout3rd Quarter 2023 INDEX State Ethics Commission Quarterly Rulings for Third Quarter 2023 ADVICES (Ethics): 23-539: (Krak): Re: Whether the Public Official and Employee Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq., would impose any prohibitions or restrictions upon you following termination of your employment as a Deputy Secretary of Policy and Planning for the Policy and Planning Office within the Governor’s Office. 23-540 (Coleman): Re: Whether either of two township supervisors, each of whom is a member of a volunteer fire company that is designated as an officially recognized fire company for the township, would have a conflict of interest pursuant to Section 1103(a) of the Public Official and Employee Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1103(a), with regard to voting on the purchase of a fire vehicle for the township which would be used by the volunteer fire company. 23-541 (Brannon): Re: Whether the Public Official and Employee Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq., would impose prohibitions or restrictions upon an individual with regard to being elected and serving as a member of council for a borough that employs his son. 23-542: Re: Whether the Public Official and Employee Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq., would impose prohibitions or restrictions upon an individual serving as an \[Officer\] for the \[Political Subdivision\], who is also serving as a Member of the Board of Directors of the \[Entity\], with regard to seeking employment as the \[Position Title\] of the \[Entity\]. 23-543 (Campbell): Re: Whether the Public Official and Employee Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq., would prohibit an individual from simultaneously serving in the following three positions: (1) a Member of the Howe Township Municipal Authority; (2) a Member of the Borough of Newport Planning Commission; and (3) a County Commissioner for Perry County, Pennsylvania. - 1 - 23-544-(Kinder): Re: Whether, as the Mayor of the City of Meadville (“City”), you would have a conflict of interest under Section 1103(a) of the Public Official and Employee Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1103(a), with regard to participating in matters before City Council related to issues of concern to a nonprofit advocacy organization named “Pennsylvania United” (“PA United”) or a local chapter of PA United, Crawford County United, when you are employed as the Member Organizer for PA United. 23-545: Re: Whether, following termination of your employment as a \[Position\] with the \[Commonwealth Agency\], the post- employment restrictions of Section 1103(g) of the Public Official and Employee Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1103(g), would apply to prohibit you, in your role as an associate with a law firm, from lobbying the \[Commonwealth Agency\] on behalf of clients of the law firm. 23-546 (McKinney): Re: Whether the Public Official and Employee Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq., would permit a Member of Council for Burgettstown Borough (“Borough”) to simultaneously serve as a Borough public works employee. 23-547-(Jumper): Re: Whether the Public Official and Employee Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq., would impose prohibitions or restrictions upon a state legislator in her capacity as a public official if the state legislator, in her private capacity, would become a member of the board of directors of a 501(c)(3) non-profit organization that provides services to individuals suffering from substance use disorders and abuse. 23-548: Re: Whether the Public Official and Employee Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq., would impose restrictions upon an individual with regard to performing work for his new employers, \[Entity 1\] and \[Entity 2\], following termination of his employment as a \[Public Position\] with \[Commonwealth Body 1\]. 23-549 (Sniegocki): Re: Whether the Public Official and Employee Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq., would impose restrictions upon you with regard to performing work in your position as a Mass Transit Manager 1 for the Pennsylvania Department of Transportation (“PennDOT”) following termination of your employment as the Director of Road Operations for Pittsburgh Regional Transit. - 2 - 23-550: Re: Whether the Public Official and Employee Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq., would impose any prohibitions or restrictions upon you following termination of your employment as a \[Position\] for the \[Commonwealth Entity\]. - 3 -
