Spahr: The Ethics Commission has reviewed allegations) that you have violated the Ethics ;pct, Act 1978 -17(x, Tn nature of the alleged violation(s) a_• fo"i 1 ows : That you, a Supervisor and Roadmaster• of Union Township, violated Section 3(a) of the Ethics Act which prohibits a public official's use of office or . confidential information gained from that office to realize financial gain other than compensation allowed by a, when you voted to appoint yourself as township roadmaster, Or May 2, 1986, the Commission issued Order No. 457 -R to Mr. pack Gabig. In that order we found: Conclusion: Your act in voting for yourself to a position of employment in a township of the second class, where you served as a township supervisor, is not ir; :accord with our most recent interpretation of the State .Ethics Act. In light of the fact, however, that you actions in this matter predated our King Opinion; and that there are no other factors which indicate that you intentionally attempted to obtain financial gain in violation of the law, we will take no further action in this matter. We do note that the decision in this particular arse is a result of the specific factors outlined herein and That such decision could E,e different under other circumstances The circumstances in your case are essentially the same as in Gabig.
