Miller, Commissioner Bureau of Professional & Occupational Affairs 6th Floor, Transportation & Safety Building Harrisburg, PA 17120 RE: Secretary of the Veterinary Board Serving on an Animal Technician Advisory Committee of a Junior College. On November 2, 1979, Stanley Miller, Commissioner of the Bureau of Professional & Occupational Affiars advised us that Dr. Lillian A. Giuliani, member and Secretary of the Veterinary Board of Medical Examiners, has requested a ruling on the following situation: She has been requested to serve on the Animal Technician Advis- ory Committee of Harcum Junior College. The Veterinary Board of Medical Examiners sets the standards for licensing Animal Technicians. They also have given the exami- nation in this area, although an outside testing agency is being employed in the future to do this work. The issue is whether a member and Secretary of the Veterinary Board of Medical Examiners may serve on an Animal Technician Advis- ory Committee of a junior college? Section 1 of the State Ethics Act requires that public offi- cials "present neither a conflict nor the appearance of a conflict with the public trust." As long as Dr. Giuliani does not in any way participate in the examining of any applicant from Harcum Junior College, she is not giving the appearance of a conflict with the public trust. Stanley A. Miller January 17, 1980 Page 2 CONCLUSION: PJS:alf -3 A member and secretary of the Veterinary Board of Medical Examiners may serve on an Animal Technician Advisory Committee of a junior college as long as he or she does not personally pass on any application from a student, or a person who has graduated from within one year, of that junior college. Pursuant to Section 7(9)(i), this opinion is a complete de- fense in any enforcement proceeding initiated by the Commission, and evidence of good faith conduct in any other civil or criminal proceeding, providing the requestor has disclosed truthfully all the material facts and committed the acts complained of in reliance on the advice given. such.
