Dear Mr. Willey: STATE ETHICS COMMISSION 308 FINANCE BUILDING HARRISBURG, PENNSYLVANIA 17120 August 5, 1980 ADVICE OF THE COMMISSION 80 -701 On July 15, 1980, you asked whether there would be a conflict of interest under Act 170 if you should accept a contract as a part -time evening school instructor in the Wharton School of the University of Pennsylvania. You noted that, as as Senior Financial Advisor of the Democratic staff of the House of Appropriations Committee, you review and analyze appropriation request from the University of Pennsylvania which is the parent university of the Wharton Graduate School. You further stated that you have no responsibility for drafting the appropriations bill and the actual amount of funds provided is determined by two - thirds vote of the House and Senate. And that you were contacted for this teaching role by a part -time instructor and not by representatives of the University of Pennsylvania who would be active in the appropriation activities. Acceptance of the part -time teaching contract with the Wharton school would not create a conflict prohibited by Act 170 -1978. If, during the term of your teaching contract, a matter comes before you, in your official position, concerning the University of Pennsylvania you should disqualify yourself from participating in that decision. Pursuant to Section 7(9)(ii), this advice is a complete defense in any enforcement proceeding initiated by the Commission, and evidence of good faith conduct in any other civil or criminal proceeding, providing the requestor has disclosed truthfully all the material facts and committed the acts complained of in reliance on the Advice given.
