Dear Mr. Luzaich:

30B FINANCE BUILDING
HARRISBURG, PENNSYLVANIA 17120
ORDER OF THE COMMISSION
August 13, 1981
No. 68
#81 -62 -C
#81 -63 -C
On June 17, 1981, you were notified that the State
Ethics Commission had received a complaint regarding you and
a possible violation of Act 170 of 1978. The Commission has
completed its investigation into these allegations and finds
there was a violation of the Act when you failed to report
all required sources of income.
The allegations and findings on which our conclusion is
based follow:
Allegation: That you failed to report sources of
income from Emil's Lounge and Emil's Catering on Line 15 of
your Financial Interest Statement; and that you failed to
report financial interests in these businesses on Line 19.
Conclusion: Section 5(b) of the Ethics Act requires
the reporting of direct or indirect sources of income totaling
in the aggregate of $500 or more. You submitted a letter
dated July 8, 1981 listing more specific information on
these sources of income and interests in Items 15 and 19 on
your Financial Interest Statement. While the failure to
list these sources and interests is a violation of the Act,
you corrected your Statement as soon as the requiements
were - clarified and the Commission accepts your. revised
Statement. A copy of your letter will be sent to the Borough
of Rankin to be attached to your. original Financial Interest
Statement. The Commission will take no further action on
this matter.
