Sarosky 147 Middletown Jeddo, PA 18224 Re: 85 -054 -C "1Y STATE ETHICS COMMISSION 308 FINANCE BUILDING HARRISBURG, PENNSYLVANIA 17120 ORDER OF THE COMMISSION November 4, 1985 Order No. 430 Dear Mr. Sarosky: The State Ethics Commission has received a complaint regarding you and a possible violation of Act 170 of 1978. The Commission has now completed its investigation. The individual allegations, conclusions, and findings on which those conclusions are based are as follows: I. Allegation: That you, a candidate for Auditor in Hazle Township, violated Section 4(e)(2) of the Ethics Act and 4.2(b) of the Ethics Commission regulations which provides that candidates for local public office shall file a Statement of Financial Interests with the State Ethics Commission and the governing authority of the political subdivision in which he is a candidate prior to filing a petition to appear on the ballot because you filed late with Hazle Township and with the State Ethics Commission. A. Findings: 1. You were a candidate for auditor of Hazle Township in the 1985 primary election and, as such, are subject to the filing requirements of the State Ethics Act. 2. The State Ethics Commission received the original of your Statement of Financial Interests on May 13, 1985, in response to a certified letter notifying you of your obligation to file with the Commission. 3. You state that you mailed a copy of your Statement of Financial Interests to Hazle Township in March, 1985. a. The township did not receive that statement at that time; b. On August 19, 1985, the township acknowledged receipt of a copy of your statement dated March 7, 1985. Mr. Joseph M. Sarosky _Page 2 4. You were nominated at the primary election. B. Discussion: Section 4. Statement of financial interests required to he filed. (2) Any candidate for local office shall file a statement of financial interests with the commission pursuant to this act and shall file a copy of that statement with the governing authority of the political subdivision in which he is a candidate. 65 P.S. 404(2). November 4, 1985 While we find no evidence to support your claim that you mailed a Statement of Financial Interests to the township in March of 1985, we also find no evidence that you were able to realize financial gain or other advantage by not filing your Statement of Financial Interests. You have now filed statements with the State Ethics Commission and the township. However, we must caution you that now that you understand your filing obligations, we would look at any future failure to file as required by the Ethics Act as an intentional action. C. Conclusion: You violated Section 4(e)(2) of the Ethics Act but we will take no further action because you have now filed your Statements of Financial Interests. Our files in this case will remain confidential in accordance with Section 8(a) of the Ethics Act, 65 P.S. 408(a). However, this Order is final and will be made available as a public document 15 days after service (defined as mailing) unless you file documentation with the Commission which justifies reconsideration and /or challenges pertinent factual findings. See 51 Pa. Code 2.38. During this 15 -day period, no one, including the Respondent unless he waives his right to challenge this Order, may violate this confidentiality by releasing, discussing or circulating this Order. Any person who violates the confidentiality of a Commission proceeding is guilty of a misdemeanor and shall be fined not more than $1,000 or imprisoned for not more than one year or both, see 65 P.S. 409(e).
