The Commission has now completed its investigation. The individual allegations, conclusions, and findings on which those conclusions are based are as follows: I. Allegation: That you, a School Director of Wyoming Valley West, violated Section 5(h)5 of the Ethics Act which requires reporting of all sources of income of $500 or more by failing to report the Club 752 as a source of income. A. Findings: 1. You served as a School Director of Wyoming Valley West at least in 1983 and 1984 and, as such, are subject to the provisions of the Ethics Act (Act 170 - 1978). 2. Club 752 is not listed as a source of income on your Statements of Financial Interests dated April 6, 1984 and March 7, 1983. 3. Andrew Kovalchik, Certified Public Accountant for Cluh 752, states that you did not receive compensation from the Club nor were any W -2's or 1099's issued to you for any form of compensation. B. Discussion: Section 5. Statement of financial interests. (b) The statement shall include the following information for the prior calendar year with regard to the person required to file the statement and the members of his immediate family: Mr. Vivian Gullo Page 2 Novemher 4, 1985 (5) The name and address of any person who is the direct or indirect source of income totalling in the aggregate of $500 or more. However, this provision shall not be construed to require the divulgence of confidential information protected by statute or existing professional codes of ethics. You stated, and the Certified Public Accountant for Club 752 has confirmed that you received no income from Club 752 and, therefore, had nothing to report. C. Conclusion: We find no violation of Section 5(b)5 of the Act because Club 752 was not a source of income during 1983 or 1984. We will take no further action on this case. Our files in this case will remain confidential in accordance with Section 8(a) of the Ethics Act, 65 P.S. 408(a). However, this Order is final and will be made available as a public document 15 days after service (defined as mailing) unless you file documentation with the Commission which justifies reconsideration and /or challenges pertinent factual findings. See 51 Pa. Code 2.38. During this 15 -day period, no one, including the Respondent unless he waives his right to challenge this — Trder, may violate this confidentiality by releasing, discussing or circulating this Order. Any person who violates the confidentiality of a Commission proceeding is guilty of a misdemeanor and shall be fined not more than $1,000 or imprisoned for not more than one year or both, see 65 P.S. 409(e).
