ORDER OF COMMISSION

Order No. 293
The State Ethics Commission has reviewed the possibility that you have
violated the State Ethics Act, Act 170 -1978. The nature of the alleged
violation is as follows:
I. Allegation: That as a public official, you failed to file a Statement of
Financial Interests by May 1, 1983, for calendar year 1982, as required by the
State Ethics Act and regulations.
A. Findings:
1. An audit of the Statement of Financial Interests for calendar year
1982 required to be filed by May 1, 1983, was conducted by the State
Ethics Commission. Your statement was not on file.
2. You served as a compensated member of the Drug and Alcohol Abuse
Council during calendar year 1982.
a. The law applicable to this entity specifies that its members are
authorized to receive compensation other than reimbursement for
expenses.
b. You currently serve in this office.
c. The powers and duties of this Council as set forth in the laws of
this Commonwealth include the power to:
1) develop, adopt and coordinate the implementation of a
comprehensive health, education and rehabilitation program
for the prevention and treatment of drug and alcohol abuse
and dependence under the Drug and Alcohol Abuse and Control
Act, 71 P.S. 1690.101 et seq.;

2) appoint an Executive Director to whom they may delegate
supervision of the administration of council activities
including, with the approval of council, the authority to
employ personnel and consultants needed to carry out the
council's duties;
3) adopt a State plan for the control, prevention, treatment,
rehabilitation research, education, and training aspects of
drug and alcohol abuse and dependence problems, including
coordination of all state agencies in this field.
4) prepare general regulations for and the operation of programs
supported with assistance under the Drug and Alcohol Abuse
Control Act;
5) establish priorities for deciding allocation of the funds
under said Act;
6) require local and State departments, agencies, institutions
and others engaged in implementation of the State plan to
submit reports to evaluate efforts of the State plan and
law and to recommend appropriate amendments to the State
plan;
7) through the Executive Director, direct performance audits of
any activity engaged in pursuant to the State plan;
8) make recommendations to the General Assembly as will further
the prevention, treatment and control of drug and alcohol
abuse and dependence;
9) provide for facilities in each region or city or catchment
area to provide information about programs /services under
their law and jurisdiction;
10) adapt a seal for authentication of its records.
3. You are a public official as that term is used in the Ethics Act.
4. You have not filed a Statement of Financial Interests for calendar
year 1982.
5. A letter was addressed to you by the Executive Director of the State
Ethics Commission, Edward M. Seladones.

a. This letter was dated August 3, 1983.
b. This letter was addressed to you at 251 Eddington Avenue,
Harrisburg, Pennsylvania 17111.
c. This letter was mailed regular first class mail.
d. We received no response to this letter.
6. Another letter was addressed to you by the Executive Director of the
State Ethics Commission, Edward M. Seladones.
a. This letter was dated November 4, 1983.
b. This letter was addressed to you at 251 Eddington Avenue,
Harrisburg, Pennsylvania 17111.
c. This letter was mailed certified, return receipt requested, No.
407583393. This letter was returned to the State Ethics
Commission marked "unclaimed."
d. We received no response to this letter.

7. We had not received your Statement of Financial Interests as of
April 24, 1984.
a. We issued an Order on April 24, 1984.
b. On May 3, 1984, we received your Statement of Financial Interests
for calendar year 1982 and a letter requesting reconsideration.
c. In your letter requesting reconsideration you stated the
fol lowing:
1. You failure to file a Statement of Financial Interests was an
oversight.
2. You had not received our previous notices because you had
been traveling extensively and had been out of the country
when our certified letter was mailed to you.

B. Discussion:
Section 4. Statement of financial interests required to be filed.
(a) Each public employee employed by the Commonwealth
shall file a statement of financial interests for the
preceding calendar year with the department, agency or
bureau in which he is employed no later than May 1 of each
year that he holds such a position and of the year after
he leaves such a position. Any other public employee
shall file a statement of financial interests with the
governing authority of the political subdivision by which
he is employed no later than May 1 of each year that he
holds such a position and of the year after he leaves such
a position. 65 P.S. 404(a).
You were required to file a Statement of Financial Interests for calendar
year 1982. You have now filed a statement. Although your late filing
violated Section 4(a) of the Ethics Act, we find no evidence that this late
filing was intended to conceal information or realize financial gain.
C. Conclusion: You violated Section 4(a) of the Ethics Act but we believe
that this violation was not intentional and did not conceal information which
would have allowed you to realize financial gain and will take no further
action.
Our files in this case will remain confidential in accordance with Section
8(a) of the Ethics Act, 65 P.S. 408(a), However, this Order is final and will
be made available as a public document in accordance with 51 Pa. Code
2.38(a).
Any person who violates the confidentiality of a Commission proceeding is
guilty of a misdemeanor and shall be fined not more than $1,000 or imprisoned
for not more than one year or both, see 65 P.S. 409(e).
