Kennedy Drive McAdoo, PA 18237 Re: #83,31 -C Dear Mr. Lazur: STATE ETHICS COMMISSION 308 FINANCE BUILDING HARRISBURG, PENNSYLVANIA 17120 ORDER OF THE COMMISSION May 20, 1983 Order No. 199 The Ethics Commission has reviewed the allegation(s) that you have violated the Ethics Act, Act 1978 -170. The nature of the alleged violation(s) is as follows: I. Allegation: That you, as a candidate in the 1983 Primary Election, failed to list the Borough of McAdoo as a source of income of $500 or more and that this violates Section 5(b)5 of the Ethics Act. A. Findings: 1. Item 15, direct or indirect sources of income, of your Financial Interest Statement filed for calendar year 1982 contained the word none. 2. You did receive $500 or more from the Borough of McAdoo for your position as council person in that Borough. B. Discussion: Section 5(b)5 of the Ethics Act requires: The name and address of any person who is the direct or indirect source of income totalling in the aggregate $500 or more. However, this provision shall not be construed to require the divulgence of confidential information protected by statute or existing Professional Codes of Ethics. You have now filed an amendment to your statement listing the Borough of McAdoo as a source of income of $500 or more and we find no reason to believe that this discrepancy was anything more than an oversight. C. Conclusion: Although you technically violated Section 5(b)(5) of the Act, the Borough of McAdoo is now listed as a source of income and available for the public's information. The Commission will take no further action on this matter. Mr. Andrew J. Lazur May 20, 1983 Page 2 Our files in this case will remain confidential in accordance with Section 8(a) of the Ethics Act, 65 P.S. 408(a). However, this Order is final and will be made available as a public document 15 days after service unless you file documentation with the Commission which justifies reconsideration and /or challenges pertinent factual findings. See 51 Pa. Code 2.38. During this 15 -day period, no one, including the Respondent unless he waives his right to challenge this Order, may violate this confidentiality by releasing, discussing or circulating this Order. Any person who violates the confidentiality of a Commission proceeding is guilty of a misdemeanor and shall be fined not more than $1000 or imprisoned for not more than one year or both, see 65 P.S. 409(e).
