HomeMy WebLinkAbout143 PasserottiMr. Tracy Passerotti 8980 Rohl Road North East, PA 16428 Dear Mr. Passerotti: STATE ETHICS COMMISSION 308 FINANCE BUILDING HARRISBURG, PENNSYLVANIA 17120 ORDER OF THE COMMISSION July 22, 1982 No. 143 (FIS) #82 -66 -C The State Ethics Commission has reviewed the possibility that you have violated the State Ethics Act, #170 -78. The nature of the alleged violation is as follows: I. Allegation: That as a former public official, you failed to file a Financial Interest Statement as required by the State Ethics Act by May 1 of 1982 for the calendar year 1981. II. Findings: 1. You served as a Township Supervisor for Harborcreek Township during calendar year 1981. 2. You were defeated in the November 1981 General Election for a successive term, and, therefore, left office as of December, 1981. 3. Harborcreek Township officials have confirmed you failed to file a Financial Interest Statement with their office by May 1, 1982 as required by Section 4(a) of the Ethics Act, 65 P.S. 404(a) for calendar year 1981. 4. Harborcreek Township officials further confirm the fact that they sent a blank Financial Interest form and a letter to you informing you of your requirement to file the Financial Interest Statement. They received no response from you. 5. Under Commission policy relating to persons who have failed to file the required Financial Interest Statement, a certified letter was sent to you by the State Ethics Commission on June 3, 1982 with the address of 8980 Rohl Road, Harborcreek, PA, 16421. Mr. Tracy Passerotti July 22, 1982 Page 2 That piece/Of mail was forwarded to the North East Post Office, 16428, for delivery. The North East Post Office attempted to deliver three times: June 7, June 12 and June 22, 1982. The letter was returned to the Ethics Commission "unclaimed." 6. To date, you have failed to file a Financial Interest Statement as required by the State Ethics Act. This failure to file a Financial Interest Statement by May 1, 1982 was recently verified on May 25, 1982 by contact with Eleanor H. Musgrave, secretary of Harborcreek Township. III. Conclusions: You were obligated by provisions of the State Ethics Act as cited above to — rile a Financial Interest Statement for each year in which you held office and the year following your departure from office. As a former public official who left office in 1981, you were required to file such a Statement by May 1, 1982. You have failed to file such a Statement and apparently refuse to do so despite being advised of this requirement as set forth above. Accordingly, we must find that you have violated the Ethics Act and are subject to the penalties as set forth in Section 9(b) of the Ethics Act, 65 P.S. 409(b). This conclusion and the above information will be forwarded to the District Attorney of Erie County for his review and possible prosecution. Our files in this case will remain confidential in accordance with Section 8(a) of the Ethics Act, 65 P.S. 408(a). However, this Order is final and will become available as a public document within 15 days unless you file documentation with the Commission which justifies reconsideration and /or challenges pertinent factual findings. During this 15 -day period, no one, including the Respondent unless he waives his right to challenge this Order, may violate this confidentiality by releasing, discussing or circulating this Order. Any person who violates the confidentiality of a Commission proceeding is guilty of a misdemeanor and shall be fined not more than $1000 or imprisoned for not more than one year or both, see 65 P.S. 409(e).
