ORDER OF THE COMMISSION

The State Ethics Commission has received a complaint regarding you and a
possible violation of Act 170 of 1978. The Commission has now completed its
investigation into these allegations and finds no violation of Act 170.
The individual allegations and findings on which our conclusion is based
I. Allegation: That you have completed "tap -in" work, which was then
inspected by an Inspector of the Authority on which you serve, despite the
March 18, 1980 Order of the Commission which prohibited these activities.
II. Allegation: That you restored the property of Mr. William Acheson,
Finleyville, Pennsylvania, from damages caused during construction of a sewer
line by the Peters Creek Sanitary Authority; that this violated the Ethics Act
in that you were a member of the Authority while this was done and contracted
or subcontracted with your governmental body without proper public notice.
III. Discussion: On December 18, 1980, issues which were the same or simiaar
to those raised in these allegations were heard and resolved in the Court of
Common Pleas of Washington County, Pennsylvania by Judge John Bell.
One forum for resolving questions as to the application of law is the
court system. In this case, the Court has already heard and resolved the
issues raised in these allegations and it would be counter- productive for the
Commission to pursue these matters unless significant new information was
uncovered or provided. Given the Court action and ruling, we therefore find
there is no need to proceed with this action.
IV. Conclusion: Given the Court action and ruling we find no reason for the
State Ethics Commission to believe that you have violated Act 170 or the Order
of March 18, 1980, and the Commission will take no further action.

Our file in this case will remain confidential in accordance with Section
3(a) of the Ethics Act, 65 P.S. 408(a). However, this Order is final and will
become available as a public document within 15 days unless you file
documentation with the Commission which justifies reconsideration and /or
challenges pertinent factual findings. During this 15 -day period, no one,
including the Respondent unless he waives his right to challenge this Order,
may violate this confidentiality by releasing, discussing, or circulating this
Order. ,
Any person who violates the confidentiality of a Commission proceeding is
guilty of a misdemeanor and shall be fined not more that $1000 or imprisoned
for not more than one year or both, see 65 P.S. 409(e).
