The Ethics Commission has received a complaint alleging that you have
violated the Ethics Act, Act 1978 -170. The nature of the alleged violation is
as follows:
1. That as a Councilmembee in West Fairview Borough you participated in a
meeting of November 18, 1982 or March 8, 1982 to appoint a person to a vacancy
on Council which did not conform to the proper method of voting and which led
to the appointment of a person who did not then properly file a Financial
Interest Statement.
Discussion The question of violation of any constitutionally mandated voting
methods is not within the purview of the Ethics Act or this Commission.
Even assuming that your appointee may not have properly filed a Financial
Interest Statement, you cannot be said to have violated any provision of the
Ethics Act because of someone else's alleged failure. ,
Conclusion: You have not violated any provision of the Ethics Act. Other
items are not within the jurisdiction of the Commission under the Ethics Act.
Our files in this case will remain confidential in accordance with
Section 8(a) of the Ethics Act, 65 P.S. 408(a). However, this Order is final
and our file in this matter is closed.
