The State Ethics Commission has received a complaint regarding you and a
possible violation of Act 170 of 1978. The Commission has now completed its
investigation into these actions and finds a violation.
I. Allegation: That you, a Township Supervisor, did not file a Statement of
Financial Interest as required by the State Ethics Act.
Findings: As a Township Supervisor, you are a public official subject to
the terms of Act 170.
A Financial Interest Statement was not on file at the Township offices
on or before May 1, 1982.
Your Financial Interest Statement was filed on May 21, 1982; it was dated
April 26, 1982.
Discussion: Section 4 of the Ethics Act and Commission regulations
require that public officials file a Statement of Financial Interest for
the preceding calendar year by May 1, of each year they hold office and
of the year after they leave office.
The purpose of the Ethics Act is served when Financial Interest
Statements are on file and available to the public for inspection.
While you should have filed your statement by May 1, you have now filed
and this is an adequate remedy to your initial failure to meet the
deadline.
Conclusion: You violated Act 170 by not filing your Financial Interest
Statement by May 1, 1982. However, you have now filed and your
statement is available to the public. The Commission accepts this
filing and will take no further action in this case.

Our file in this case will remain confidential in accordance with Section
8(a) of the Ethics Act, 65 P.S. 408(a). However, this Order is final and
will become available as a public document within 15 days unless you file
documentation with the Commission which justifies reconsideration and /or
challenges pertinent factual findings. During this 15 -day period, no one,
including the Respondent unless he waives his right to challenge this Order,
may violate this confidentiality by releasing, discussing or circulating this
Order.
Any person who violates the confidentiality of a Commission proceeding is
guilty of a misdemeanor and shall be fined not more than $1000 or imprisoned
for not more than one year or both, see 65 P.S. 409(e).
