Easton Road Glenside, PA 19038 4398 Re: #81 -86 -C STATE ETHICS COMMISSION 308 FINANCE BUILDING HARRISBURG, PENNSYLVANIA 17120 ORDER OF THE COMMISSION January 5, 1982 No. 97 Dear Ms. McGarry: The State Ethics Commission has received a complaint regarding you and a possible violation of Act 170 of 1978. The Commission has now completed its investigation into these actions and finds a no actionable violation. The individual allegation and finding on which our conclusion is based are: I. Allegation: That you did not file a Financial Interest Statement with the Penn Township Clerk as required by Section 4 of the Ethics Act. Findings /Discussion: You were a candidate for Township Treasurer /Tax Collector in the Township of Abington, Montgomery County for the May 19, 1981 Primary Election. As a candidate for public office, you are required to file a Financial Interest Statement with the State Ethics Commission and the governing authority of the political subdivision in which you are a candidate before filing a petition to appear on the ballot. You did file a Financial Interest Statement with the State Ethics Commission received by the State Ethics Commission as of March 11, 1981 and signed as of March 5, 1981. This meets the Commission policy on candidate filings for this office. However, the copy of this Financial Interest Statement which you swear you filed with Abington Township as required by Commission Regulations apparently was mislaid. Ms. Barbara McGarry January 5, 1982 Page Z - You have now filed another copy of this Statement with the Abington Township Manager. Conclusion: Since your Financial Interest Statement is now on file with Abington Township and was filed properly with the State Ethics Commission, the Commission will take no further action. This decision is not to be viewed as a precedent. It applies only to this situation. Our files in this case will remain confidential in accordance with Section 8(a) of the Ethics Act, 65 P.S. 408(a). However, this Order is final and will become available as a public document within 15 days unless you file documentation with the Commission which justifies reconsideration and /or challenges pertinent factual findings. During this 15 -day period, no one, including the Re- spondent and /or Complainant, may violate this confidentiality by releasing, discussing or circulating this Order. Any person who violates the confidentiality of a Commission proceeding is guilty of a misdemeanor and shall be fined not more than $1000 or imprisoned for not more than one year or both, see 65 P.S. 409(e).
