The Commission has now completed its investigation. The individual allegations, conclusions and findings on which those conclusions are based are as follows: I. Allegation: That you failed to disclose real estate interest and income from same on your Financial Interest Statement filed January 29, 1981. A. Findings: 1. As a borough councilperson you are a public official and subject to the requirements of the Ethics Act. 2. You filed a Financial Interest Statement which was dated January 29, 1981 and contained information for calendar year 1980. 3. Item3 on that statement contained a listing of "1414 & 1416 Farragut Avenue, Bristol, PA ". The item was lined through and the word "omit" written after it. This was personal real estate and did not involve a real estate transaction with the Commonwealth or any politigal subdivision. 1 4. You received income from this real estate but did not realize a profit of $500.00 or more. 5. You did not report this real estate as a source of income on Item 15 of the Financial Interest Statement because you had not realized adjusted gross income of $.500.00 or more from this property. Thomas Corrigan February 28, 1983 Page 2 6. There is no evidence of real estate transactions with the Commonwealth or any other political subdivisions. Discussion: Section 5(b)(3) of the Ethics Act requires: Any direct or indirect interest in any real estate which was sold or leased to the Commonwealth, any of its agencies or political subdivisions; purchased or leased from the Commonwealth, any of its agencies or political subdivisions; or which was the subject of any condemnation proceedings by the Commonwealth, any of its agencies or political subdivisions. 65 PS. 404(5)(b)(3). The property on Farragut Avenue was not one that involved the Commonwealth or a political subdivision and you were correct in omitting it from Item 13 on the Financial Interest Statement. Section 5(b)(5) of the Act requires reporting of all sources of income of $500.00 or more. The regulations of the State Ethics Commision in effect at the time you filed defined "income" as adjusted gross income. You did not realize $500.00 or more of adjusted gross income from this real estate and thus were not required to report it as a source of income. Conclusion: You did not violate the Ethics Act by omitting a listing of the property on Farragut Avenue because this was neither real estate involving transactions with the Commonwealth, its agencies or political subdivisions or a source of income of $500.00 or more. Our files in this case will remain confidential in accordance with Section 8(a) of the Ethics Act, 65 P.S. 408(a). However, this Order is final and will bk made available as a public document within 15 days after service unless you file documentation with the Commission which justifies reconsideration and /or challenges pertinent factual findings. See 51 Pa. Code 2.38. During this 15 -day period, no one, including the Respondent unless he waives his right to challenge this Order, may violate this confidentiality by releasing, discussing or circulating this Order. Any person who violates the confidentiality of a Commission proceeding is guilty of a misdemeanor and shall be fined not more than $1000 or imprisoned for not more than one year or both, see 65 P.S. 409(e).
