Joy, PA 17552 Re: x[81 -72 -C (3 -7) Dear Mr. Miller: STATE ETHICS COMMISSION 308 FINANCE BUILDING HARRISBURG, PENNSYLVANIA 17120 ORDER OF THE COMMISSION October 13, 1981 No. 84 The State Ethics Commission has received a complaint regarding you and a possible violation of Act 170 of 1978. The State Ethics Commission has completed its investigation into these allegations and finds there was a violation of the Act when you failed to report all required sources of income. The individual allegations and findings on which our conclusion is based are: I. Allegation: That you failed to disclose your wife's occupation on your Financial Interest Statement. II. Allegation: That income in Item 15 III. Allegation: That income in Item 15 IV. Allegation: That guest farm income Statement. you failed to disclose your farm on your Financial Interest Statement. you failed to disclose your wife's on your Financial Interest Statement. you failed to disclose your tourist - in Item 15 on your Financial Interest V. Allegation: That you failed to disclose an all - expense paid trip as a gift in Item 16 on your Financial Interest Statement. VI Findings /Discussion: Section 5 of Act 170 requires the name and address of any person (a business, individual, corporation, union, association, firm, partnership, committee, club, or other organization or group of persons) who is the direct or indirect source of income totaling in the aggregate of $500 or more. Miller October 13, 1981 Page -2- Section 5 also requires the name and address of any person, from whom a gift or gifts valued in the aggregate of $200 or more were received, and the value and circumstances of each gift. You have amended your Statement to include all reportable items. VII. Conclusion: While the failure to give complete information in Items 15 and 16 is a violation of the Act, you have amended your Statement to include all reportable items. The Commission accepts this amendment and will take no further action. This decision is not to be viewed as a precedent. It applies only to this situation. Future violations will be reviewed and the Commission will take all possible actions to enforce the law and provide fi- nancial interest information to the public. Our files in this case will remain confidential in accordance with Section 8(a) of the Ethics Act, 65 P.S. 408(a). However, this Order is final and will become avail- able as a public document within 15 days unless you file documentation with the Conuuission which justifies recon- sideration and /or challenges pertinent factual findings. During this 15 -day period, no one, including the Re- spondent and /or Complainant, may violate this confidentiality by releasing, discussing or circulating this Order. Any person who violates the confidentiality of a Commission proceeding is guilty of a misdemeanor and shall be fined not more than $1000 or imprisoned for not more than one year or both, see 65 P.S. 409(e).
