D. #4, Box 235 Manheim, PA 17545 Re: #81 -71 -C (2 -7) Dear Mr. Lefever: STATE ETHICS COMMISSION 308 FINANCE BUILDING HARRISBURG, PENNSYLVANIA 17120 ORDER OF THE COMMISSION October 13, 1981 No. 83 The State Ethics Commission has received a complaint regarding you and a possible violation of Act 170 of 1978. The State Ethics Commission has completed its investigation into these allegations and finds there was a violation of the Act when you failed to report all required sources of income. The individual allegations and findings on which our conclusion is based are: I. Allegation: That you incorrectly disclosed your wife's occupation on your Financial Interest Statement, II. Allegation: That you failed to disclose your wife's source of income in Item 15 on the Financial Interest Statement. III. Findings /Discussion: Section 5(b) of the Ethics Act requires the name and address of any person (a business, individual, corporation, union, association, firm, partnership, committee, club or other organization or group of persons) who is the direct or indirect source of income totaling in the aggregate of $500 or more. IV. Conclusion: While the failure to list your wife's occupation and source of income is a violation of the Act, you corrected your Statement at the Township. The Commission accepts this and will take no further action. You have amended your Statement to include all reportable items. Mr. Titus H. Future violations will be reviewed and the Commission will take all possible actions to enforce the law and provide fi- nancial interest information to the public. Our files in this case will remain confidential in accordance with Section 8(a) of the Ethics Act, 65 P.S. 408(a). However, this Order is final and will become avail- able as a public document within 15 days unless you file documentation with the Commission which justifies recon- sideration and /or challenges pertinent factual findings. During this 15 -day period, no one, including the Re- spondent and /or Complainant, may violate this confidentiality by releasing, discussing or circulating this Order. Any person who violates the confidentiality of a Commission proceeding is guilty of a misdemeanor and shall be fined not more than $1000 or imprisoned for not more than one year or both, see 65 P.S. 409(e).
