ORDER OF THE COMMISSION
October 13, 1981
No. 82
The State Ethics Commission has received a complaint
regarding you and a possible violation of Act 170 of 1978.
The Commission has now completed its investigation into
these allegations and finds no violation of Act 170.
The individual allegations and findings on which our
conclusion is based are:
I. Allegation: That as Mayor of Bridgeville, PA, you
issued an Executive Order to the Bridgeville Police
Department directing Officers thereof to call South
Hills Ambulance Service (SHAS) to supply ambulance
transportation within the community.
II. Allegation: That you are on the Board of Directors of
SHAS.
III. Allegation: That your decision and directive referred
to above (No. I) violates Section 1, 3(a), 3(b) or 3(c)
of the Ethics Act in that you: (a.) have used your
public office or confidential information gained in
office for your own gain; (b.) hold a directorship in
SHAS and therefore, may not contract with the Borough
of Bridgeville without an open and public process and
(c.) have created an appearance of a conflict of interest
with the public trust by this action.

IV. Findings /Discussion: Section 3(c) requires an
open and public process when public officials or members
of their immediate family enter into a contract of $500
or more with the official's governmental body. There
was no such contract in this case.
V. Conclusion: There was no violation of Act 170
in your order to the South Hills Ambulance Service.
Our files in this case will remain confidential in
accordance with Section 8(a) of the Ethics Act, 65 P.S.
408(a). However, this Order is final and will become avail-
able as a public document within 15 days unless you file
documentation with the Commission which justifies recon-
sideration and /or challenges pertinent factual findings.
During this 15 -day period, no one, including the Re-
spondent and /or Complainant, may violate this confidentiality
by releasing, discussing or circulating this Order. Any
person who violates the confidentiality of a Commission
proceeding is guilty of a misdemeanor and shall be fined not
more than $1000 or imprisoned for not more than one year or
both, see 65 P.S. 409(e).

As Mayor of Bridgeville, you are a public official and
subject to Act 170. Your position as an uncompensated
Member of the Board of Directors of South Hills Ambulance
organization is not subject to Act 170. You serve with
that organization without compensation. There was no
evidence that you received any direct or indirect
financial gain from your order directing the use of the
South Hills Ambulance Service or from your position on
their Board of Directors. There was also no evidence
that you had a business relationship with Mr. Fryer
which would allow you to benefit from his previous
relationship with the South Hills Ambulance Service
organization.
