ORDER OF THE COMMISSION

The State Ethics Commission has received a complaint
regarding you and a possible violation of Act 170 of 1978.
The Commission has now completed its investigation into
these actions and finds a violation.
The individual allegation and finding on which our
conclusion is based are:
I. Allegation: That you did not file a Financial Interest
Statement with the Penn Township Clerk as required by
Section 4 of the Ethics Act.
Findings /Discussion: You were a candidate for Township
Commissioner in the Township of Penn, York County for
the May 19, 1981 Primary Election. As a candidate for
public office, you are required to file a Financial
Interest Statement with the State Ethics Commission and
the governing authority of the political subdivision in
which you are a candidate before filing a petition to
appear on the ballot.
You did file a Financial Interest Statement with the
State Ethics Commission on March 10, 1981. This meets
the Commission policy on candidate filings for this
office. However, you did NOT file a copy of this
Financial Interest Statement with Penn Township as
required by Commission Regulations. Therefore, a copy
of your Financial Interest Statement will be forwarded
to the Penn Township office for their files.

Conclusion: Since a Financial Interest Statement
is being forwarded to Penn Township, and will be avail-
able for public inspection, the Commission will take no
further action.
This decision is not to be viewed as a precedent.
It applies only to this situation. Future violations
will be reviewed and the Commission will take all
possible actions to enforce the law and provide fi-
nancial interest information to the public.
Our files in this case will remain confidential in
accordance with Section 8(a) of the Ethics Act, 65 P.S.
408(a). However, this Order is final and will become
available as a public document within 15 days unless you
file documentation with the Commission which justifies
reconsideration and /or challenges pertinent factual findings.
During this 15 -day period, no one, including the Re-
spondent and /or Complainant, may viTte this confidentiality
by releasing, discussing or circulating this Order. Any
person who violates the confidentiality of a Commission
proceeding is guilty of a misdemeanor and shall be fined not
more than $1000 or imprisoned for not more than one year or
both, see 65 P.S. 409(e).
