Dear Mr. Katerman:
The State Ethics Commission has received a complaint
regarding you and a possible violation of Act 170 of 1978.
The Commission has now completed its investigation into
these actions and finds a violation.
The individual allegation and finding on which our
conclusion is based are:
I. Allegation: That you failed to file a Financial Interest
Statement as Borough Councilman, Borough of Shillington,
for calendar year 1980, by May 1, 1981.
Findings /Discussion: The State Ethics Act and Regulations
require all current public officials and public employees
to file a Financial Interest Statement no later than
May 1 of each year you hold office and of the year
after you leave the position.
You are an incumbent- elected - public official of the
Borough of Shillington. The Borough Secretary forwarded
a copy of your Financial Interest Statement on August
12, 1981.

Conclusion: Since a Financial Interest Statement is
now on file at the Borough office, available for public
inspection, the Commission will take no further action.
This decision is not to be viewed as a precedent.
It applies only to this situation. Future violations
will be reviewed and the Commission will take all
possible actions to enforce the law and provide fi-
nancial interest information to the public.
Our files in this case will remain confidential in
accordance with Section 8(a) of the Ethics Act, 65 P.S.
408(a). However, this Order is final and will become
available as a public document within 15 days unless you
file documentation with the Commission which justifies
reconsideration and /or challenges pertinent factual findings.
During this 15 -day period, no one, including the Re-
spondent and /or Complainant, may violate this confidentiality
by releasing, discussing or circulating this Order. Any
person who violates the confidentiality of a CoLuulission
proceeding is guilty of a misdemeanor and shall be fined not
more than $1000 or imprisoned for not more than one year or
both, see 65 P.S. 409(e).
