The Commission has now completed its investigation into these allegations and finds no violation of Act 170. The individual allegation and finding on which our conclusion is based are: I. Allegation: That you failed to file a Financial Interest Statement as Borough Manager, Borough of West Reading, for calendar year 1980. Findings /Discussion: The State Ethics Act and Regulations require all current public officials and public employees to file a Financial Interest Statement no latex than May 1 of each year you hold office and of the year after you leave the position. You are an appointed - public official of the West Reading Borough serving as Borough Secretary /Manager; and, therefore, required to file a Financial Interest Statement with the Borough of West Reading no later than May 1 each year you hold the position. You forwarded a copy of your Financial Interest Statement dated April 3, 1981 to the Commission on August 11, 1981. Mr. Thomas Bagenstose August 24, 1981 Page -2- Conclusion; The Commission accepts the copy of your Financial Interest Statement as proof of filing. A copy of this Statement will be forwarded to the Borough of West Reading for their files. All Financial Interest Statements are open to the public for inspection and copying. The Commission will take no further action. Our files in this case will remain confidential in accordance with Section 8(a) of the Ethics Act, 65 P.S. 408(a). However, this Order is final and will become available as a public document within 15 days unless you file documentation with the Commission which justifies reconsideration and /or challenges pertinent factual findings. During this 15 -day period, no one, including the Re- spondent and /or Complainant, may violate this confidentiality by releasing, discussing or circulating this Order. Any person who violates the confidentiality of a Commission proceeding is guilty of a misdemeanor and shall be fined not more than $1000 or imprisoned for not more than one year or both, see 65 P.S. 409(e).
