D. # #4 Moscow, PA 18444 Re: #81 -31 -C Dear Mr. Lenzer: STATE ETHICS COMMISSION 308 FINANCE BUILDING HARRISBURG, PENNSYLVANIA 17120 ORDER OF THE COMMISSION August 24, 1981 No. 70 #81 -31 -C The State Ethics Commission has received a complaint regarding you and a possible violation of Act 170 of 1978. The Commission has now completed its investigation into these actions and finds a violation. The individual allegations and findings on which our conclusion is based are: 1. Allegation: That you have failed to file a copy of your Financial Interest Statement with the Springbrook Township Secretary's office. Findings /Discussion: The Commission conducted a pre- liminary investigation and finds the following: You were a candidate for Township Auditor in the Town- ship of Springbrook, Lackawanna County, for the May 19, 1981 Primary Election. As a candidate for public office, you are required to file a Financial Interest Statement with the State Ethics Commission and with the governing authority of the political subdivision in which you are a candidate before you file a petition to appear on the ballot. You filed a Financial Interest Statement with the State Ethics Commission on March 11, 1981. This meets the Commission policy on candidates. However, you did not file a copy of your Financial Interest Statement with the Springbrook Township office until July 27, 1981. Mr. William Lenzer August 24, 1981 Page -2- This decision is not to be viewed as a precedent. It applies only to this situation. Future violations will be reviewed and the Commission will take all possible actions to enforce the law and provide financial interest information to the public. Our files in this case will remain confidential in accordance with Section 8(a) of the Ethics Act, 65 P.S. 408(a). However, this Order is final and will become available as a public document within 15 days unless you file documentation with the Commission which justifies reconsideration and /or challenges pertinent factual findings made. During this 15 -day period, no one, including the Re- spondent and /or Complainant, may violate this confidentiality by releasing, discussing or circulating this Order. Any person who violates the confidentiality of a Commission proceeding is guilty of a misdemeanor and shall be fined not more than $1000 or imprisoned for not more than one year or both, see 65 P.S. 409(e). PJS/ j c Conclusion: Since a Financial Interest Statement is now on file at the Township office, available to the public for inspection, the Commission will take no further action.
