Dear Mr. Henry: #81 -64 -C & 81 -65 -C
The Ethics Commission has received a Complaint alleging
that you have violated the Ethics Act, Act 1978 -170. The
nature of the alleged violation /s is as follows:
Allegations: That you failed to file a Financial Interest
Statement with the State Ethics Commission prior to filing a
petition to appear on the ballot for election to public
office.
That you swore an affidavit to the foregoing fact and
attached that affidavit to your nominating petition when
filing it with the Allegheny County Board of Elections.
Conclusion: You did file a Financial Interest Statement
postmarked April 21, 1981 with the State Ethics Commission;
you did file an affidavit with your nominating petition
stating the fact that you filed a Financial Interest State-
ment on or before filing said petition.
Therefore, you have violated Section 4(b) of Act 170 of
1978. Section 9(b) sets forth the Penalty for this••violation
(a misdemeanor).
This information has been forwarded to the Allegheny
County District Attorney for their review and resolution.
All files in this case will remain confidential.
However, this Order is final and will become available as a
public document within 15 days unless you file documentation
with the Commission which justifies reconsideration and /or
challenges pertinent factual findings made.

Until this 15 -day period has expired, NO ONE, including
the Respondent- addressee, may violate the confidentiality of
these proceedings by releasing, discussing or circulating
this Order. Any person who violates the confidentiality of
a Commission proceeding is guilty of a misdemeanor and shall
be fined not more than $1,000 or imprisoned for not more
than one year or both, see 65 P.S. 409(e).
