Kurtiak 78 Benjamin Street Curtisville, PA 15032 Dear Ms. Kurtiak: STATE ETHICS COMMISSION 308 FINANCE BUILDING HARRISBURG, PENNSYLVANIA 17120 ORDER OF THE COMMISSION July 21, 1981 No. 60 #81 -36 -C On May 16, 1981, you were notified that the State Ethics Commission had received a complaint regarding you and a possible violation of Act 170 of 1978. The Commission has completed its investigation into these allegations and finds no violation of Act 170. The allegations and findings on which our conclusion is based follow: Allegation: That as a Township Supervisor in West Deer Township, you failed to list as a source of income on your Financial Interest Statement, income in excess of $500 on property you own located at 52 Butler Street. Conclusion: Correspondence from you and the Township Manager indicates that your Form due by May 1, 1981 was probably filed but lost. You submitted a copy of your Form dated February 24, 1981 and the apartment rental was listed as a source of income. You also indicated that the - rental did not meet the reporting requirements for calendar year 1980. While the Commission accepts this reporting, it is pertinent to point out that the $500 or more criterion for reporting a source income is gross income. The Commission will take no further action on this issue. Ms. Katherine S. Kurtiak July 21, 1981 Page -2- All files in this case will remain confidential. However, this Order is final and will become available as a public document within 15 days unless you file documentation with the Commission which justifies reconsideration and /or challenges pertinent factual findings made. Until this 15 -day period has expired, NO ONE, including the Respondent- addressee, may violate the confidentiality of these proceedings by releasing, discussing or circulating this Order. Any person who violates the confidentiality of a Commission proceedings is guilty of a misdemeanor and shall be fined not more than $1000. or imprisoned for not more than one year or both, see 65 P.S. 409(e).
