The State Ethics Commission has received a complaint
regarding you and possible violations of Act 170 of 1978.
The Commission has now completed its investigation into
these allegations and finds no violation of Act 170. We
find no actual conflict or appearance of a conflict based
upon the following:
I. A. Allegation - That as an elected Supervisor of
Millcreek Township, you voted to grant a zoning
change to the Zem Zem organization /club in which
you serve as an officer.
B. Findings - You are a member of the Zem Zem
organization but not an officer.
A building committee of the Shriners was established
to find a new location and selected property at W.
38th Street and Zuck Road, in Millcreek Township.
This property had been for sale for over a year.
The Shriners signed an option to purchase the
property, then filed for re- zoning in accordance
with the rules set forth by State Act 247. This
request was considered by the Millcreek Township
Planning Commission at their meetings of January 9
and February 13, 1979. The Commission voted to
recommend approval of the petition to the Board of
Supervisors by a vote of six to nothing.
You did not attend Shrine meetings dealing with
the purchase of this property nor did you meet
with anyone prior to your March 12, 1979 meeting
regarding the re- zoning of this property.
On March 12, 1979, after a public hearing, you
voted to grant the zoning change as recommended by
the Planning Commission.

All files in this case will remain confidential.
However, this Order is final and will become available as a
public document within 15 days unless you file documentation
with the Commission which justifies reconsideration and /or
challenges pertinent factual findings made.
Until this 15 -day period has expired, NO ONE, including
the Respondent- addressee, may violate the con di entiality of
these proceedings by releasing, discussing or circulating
this Order. Any person who violates the confidentiality of
a Commission proceeding is guilty of a misdemeanor and shall
be fined not more than $1000. or imprisoned for not more
than one year or both, 65 P.S. 409(e).

C. Conclusion - These facts do not support any finding
that the provisions of Act 170 have been violated.
