Kingen 2919 Hemlock Drive Erie, PA Re: #81 -20 -C STATE ETHICS COMMISSION 308 FINANCE BUILDING HARRISBURG, PENNSYLVANIA 17120 ORDER OF THE COMMISSION May 26, 1981 No. 40 #81 -20 -C (1 -4) Dear Mr. Kingen: The State Ethics Couliaission has received a complaint regarding you and possible violations of Act 170 of 1978. The Commission has now completed its investigation into these allegations and finds no violation of Act 170. We find no actual conflict or appearance of a conflict based upon the following: I. A. Allegation - That as Chief Code Enforcement Officer for Millcreek Township, you testified that proper legal advertisements were made and public hearings held in relation to an Amendment to the Township Zoning Ordinance (Amendment /Ordinance 69 -9) which testimony was allegedly false and /or secured as a reward for the positive action of the Supervisors on a re- zoning request that was of personal interest to you. B. Finding - A public notice that the petitions were presented to the Board of Supervisors of Millcreek Township, appeared in the Erie, PA Times on Friday, February 16, 1979. This notice included the petition of the Zem Zem Temple. It also announced that a public hearing on this petition would be held March 12, 1979 at 9:30 a.m. in the office of. the Board. The Millcreek Township Planning Commission also considered this action at their January 9 and February 13, 1979 meetings. In addition to the Planning Commission members, you, the Township Engineer, and Township Solicitor attended both meetings. Mr. Robert S. Kingen May 26, 1981 Page -2- At both meetings, persons attended in support of the petition, questioning the petition, and in opposition to the petition. There is no evidence their action taken on your petition on January 5, 1981 related to the actions during 1979. C. Conclusion - These facts do not support any finding that the provisions of Act 170 have been violated. All files in this case will remain confidential. However, this Order is final and will become available as a public document within 15 days unless you file documentation with the Commission which justifies reconsideration and /or challenges pertinent factual findings made. Until this 15 -day period has expired, NO ONE, including the Respondent- addressee, may violate the confidentiality of these proceedings by releasing, discussing or circulating this Order. Any person who violates the confidentiality of a Commission proceeding is guilty of a misdemeanor and shall be fined not more than $1000. or imprisoned for not more than one year or both, 65 P.S. 409(e).
