The State Ethics Commission has received a complaint
regarding you and possible violations of Act 170 of 1978.
The Commission has now completed its investigation into
these allegations and finds no violation of Act 170. We
find no actual conflict or appearance of a conflict based
upon the.following:
I. A. Allegation - That you are an officer, partner
and /or incorporator of Gerhart Equipment Co.,
Inc., Lititz, PA and Roger E. Gerhart, Inc.,
Lititz, PA. These corporations are or have been
engaged in contractual work for Warwick Township
There is a possibility of a conflict of interest
because of this or other associations.
B. Findings - That you terminated your employment
with the Gerhart Equipment Co., Inc., on August
11, 1970; that you resigned as Vice - President
October 31, 1970 and sold your shares of stock to
other partners on January 5, 1971. You have been
completely disassociated with the company as of
that date.
C. Conclusion - These facts do not support any finding
that the provisions of Act 170 have been violated.

All files in this case will remain confidential.
However, this Order is final and will become available as a
public document within 15 days unless you file documentation
with the Commission which justifies reconsideration and /or
challenges pertinent factual findings made.
Until this 15 -day period has expired, NO ONE, including
the Respondent- addressee, may violate the confidentiality of
these proceedings by releasing, discussing or circulating
this Order. Any person who violates the confidentiality of
a Commission proceeding is guilty of a misdemeanor and shall
be fined not more than $1000. or imprisoned for not more
than one year or both, 65 P.S. 409(e).
