D. #1 Berwick, PA 18603 Re: #81 -05 -C Dear Mr. Bower: STATE ETHICS COMMISSION 308 FINANCE BUILDING HARRISBURG, PENNSYLVANIA 17120 May 26, 1981 ORDER OF THE COMMISSION No. 36 #81 -05 -C (1 -3) The State Ethics Commission has received a complaint regarding you and possible violations of Act 170 of 1978. The Commission has now completed its investigation into these allegations and finds no violation of Act 170. We find no actual conflict or appearance of a conflict based upon the following: I. A. Allegation - That in your capacity as elected Supervisor and Roadmaster of Salem Township, you contracted with and permitted work to be done and paid for without adequate records to verify the work done by certain contractors. B. Finding - There was no significant difference in the maintenance of records for various contractors. C. Conclusion - These facts do not support any finding that the provisions of Act 170 have been violated. II. A. Allegation - That in your capacity as elected Supervisor of Salem Township, you voted for and contracted with your son's business for road and other work within the Township. B. Finding - Work awarded to your son was done after an appropriate bidding procedure and proper adver- tisement. There were several bids submitted and your son's firm was low bidder. C. Conclusion - These facts do not support any finding that the provisions of Act 170 have been violated. Mr. Clyde D. Bower May 26, 1981 Page -2- All files in this case will remain confidential. However, this Order is final and will become available as a public document within 15 days unless you file documentation with the Commission which justifies reconsideration and /or challenges pertinent factual findings made. Until this 15 -day period has expired, NO ONE, including the Respondent- addressee, may violate the confidentiality of these proceedings by releasing, discussing or circulating this Order. Any person who violates the confidentiality of a Commission proceeding is guilty of a misdemeanor and shall be fined not more than $1000. or imprisoned for not more than one year or both, 65 P.S. 409(e).
