The State Ethics Commission has received a complaint
regarding you and a possible violation of Act 170 of 1978.
The Commission has now completed its investigation into
these allegations and finds no violation of Act 170.
The individual allegation and findings on which our
conclusion is based are:
A. Allegation:
1. The comment in a letter from Public Utilities
Commission to Senator Zemprelli that "L. M. Sabers Bus
Lines appears to be unacceptable to the Department of
Transportation" is a violation of constitutional rights.
B. Findings:
1. You are a public employee under Act 170.
The Ethics Commission has no jurisdiction in consti-
tutional questions.
2. The Public Utilities staff did discuss the bus
service problems along Route 30 with you.

C. Discussion: The Ethics Act is not intended to
inhibit public officials or public employees from
carrying out their official responsibilities. As
the Chief of the Mass Transit Division, you would
be responsible for recommending or commenting on
mass transit issues.
D. Conclusion: There is no violation of Act 170 in
your actions relating to the bus service along
Route 30.
All files in this case will remain confidential except
that, this Order will be available as a public document.
