Dear Representative Manderino:
The State Ethics Commission has received a complaint
regarding you and possible violations of ALt 170 of 1978.
The Commission has now completed its investigation into
these allegations and finds no violation of the Act.
The individual allegation and finding on which our
conclusion is based are:
A. Allegation:
1. "There is a conflict of interest when an
elected legislator who drafts and votes on bills providing
state funds is also employed as a solicitor of one or more
of the agencies who received those funds."
B. Findings:
1. You are a public official under Act 170.
2. Some Acts of the General Assembly appropriate
funds for local governmental bodies.
3. Your Financial Interest Statement on file with
the State Ethics Commission includes a statement saying, "I
do not represent any clients before any state agency."

C. Discussion: The Commission has previously ruled there
is no inherent conflict when a person holds more than one
public office including multiple solicitorships. There is
no specific allegation nor indication that the governmental
bodies for which you serve as solicitor received unusual
benefits from legislation approved by the General Assembly.
D. Conclusion: There is no violation of Act 170 when a
Member of the General Assembly also serves as a solicitor
for one or more local governmental bodies.
All files in this case will remain confidential except
that, this Order will be available as a public document.
