Cawley Public Utilities Commission Room 101, North Office Building Harrisburg, PA 17120 80 -51 -C (3 -4) Dear Commissioner Cawley: The State Ethics Commission has received a complaint regarding you and a possible violation of Act 170 of 1978. The Commission has now completed its investigation into these allegations and finds no violation of Act 170. The individual allegation and findings on which our conclusion is based are: A. Allegation: 1. "You, as a Public Utilities Commission Member violated the Public Utilities Commission law in an action to provide bus service along the Route 30 corridor from Greensburg through North Huntingdon." B. Findings: 1. You are a public official under Act 170. 2. The State Ethics Commission has no jurisdiction in issues of the Public Utilities Commission law. 1 b Commissioner James H. Cawley February 2, 1981 Page -2- C. Discussion: Act 170 could not have been intended to inhibit a public official from carrying out his or her official responsibilities. The actions described in this case are clearly within those responsibilities. D. Conclusion: There is no violation of Act 170 in any action you might have taken as a Member of the Commission on the issue of bus service along Route 30.
