STATE ETHICS COMMISSION 308 FINANCE BUILDING HARRISBURG, PENNSYLVANIA 17120 ORDER OF THE COMMISSION February 2, 1981 No. 22 Ms. Susan Shanaman Chairman Public Utilities Commission Room 104, North Office Building Harrisburg, PA 17120 #80 -51 -C (3 -4) The State Ethics Commission has received a complaint regarding you and a possible violation of Act 170, 1978. The Commission has now completed its investigation into this allegation and finds no violation of Act 170. The individual allegation and findings on which our conclusion is based are: A. Allegation: 1. "You - and other Commission Members violated Public Utility Commission Law when you acted to provide bus service along the Route 30 corridor from Greensburg through North Huntingdon. B. Findings: 1. You are a public official under Act 170. 2. The State Ethics Commission has no jurisdiction in issues of the Public Utilities Commission law. correspond with Senator Zemprelli on the service along Route 30 and the need to Commission's authority to issue temporary C. Discussion: Act 170 could not have been intended to inhibit a public official from carrying out his or her responsibilities. The actions taken by you in this case are clearly a part of your official responsi- bilities. Conclusion: There is no violation of Act 170 when the Chairman of the Public Utilities Commission works with a corresponding Member of the General Assembly on legislative needs of that Commission nor in any of the actions you took in this case.
