Dear Mrs. Rimby:
The State Ethics Commission has received a complaint
regarding you and possible violations of Act 170, the Ethics
Act. The Couanission has completed its investigation and
finds no probable cause to conclude that any violations of
Act 170 exist.
The individual allegations and findings upon which we
based our conclusion are:
Allegation #1: That you hold a job as a Clerk
Typist II with the Department of Environmental
Resources, Bureau of State Parks and also serve
as Chairman of the Board of Directors of the
Berks County Conservation District and as
Secretary of the Pennsylvania Association of
Conservation District Directors, Inc.
Finding: There is no inherent conflict, under
Act 170, in holding such positions simultaneously.
However, while no public employee may use confi-
dential information gained in public employment
to his or her financial gain, there is no evi-
dence of any such activity in this case.
Allegation #2: That you use state telephones
and time to conduct Conservation District
business.
Finding: We find no evidence to substantiate this
allegation. Any use of State time and /or equip-
ment was incidental and beneficial to your public
employment.

This Order will be final and become available as a
public document within 20 days unless you file documentation
which justifies pertinent factual changes.
