Dear Dr. LeeDecker:
The State Ethics Commission received a complaint in-
volving you and the Pennsylvania State Association of Bor-
oughs. The State Ethics Commission has completed its inves-
tigation and has found no probable cause to believe that the
provisions of Act 170 have been violated.
The individual allegations and findings upon which our
conclusion is based are:
Allegation #1: You hold shares in an Insurance
Company which markets its group programs among
Pennsylvania State Association of Boroughs (PSAB)
membership.
Finding: The Ethics Commission has no juris-
diction over this question. The Ethics Act
applies only to public employees /officials.
In your capacity as Executive Vice - President
with Pennsylvania State Association of Boroughs,
you are neither a public employee nor public
official.
Allegation # #2: PSAB receives a certain fee,
royalty or payment as "administrative cost"
from certain insurance companies for PSAB's
role in servicing insurance contracts for
participants.
Finding: The State Ethics Commission has no
reason to believe that these payments represent
anything other than legitimate cost returns to
PSAB by these insurance companies. Furthermore,

we find no evidence that any person has offered
or given anything of value (in the form of fees,
royalties, or payments) to any public official or
public employee in order to influence that public
employee's /official's vote, official action
or judgment.
All files in this case will remain confidential.
However, this Order is final and will become available as a
public document within 15 days unless you file documentation
with the Commission which justifies reconsideration and /or
challenges pertinent factual findings made.
