Smith 101 Chestnut Street Lititz, PA 17543 Dear Mr. Smith: PJS/ j c STATE ETHICS COMMISSION 308 FINANCE BUILDING HARRISBURG, PENNSYLVANIA 17120 ORDER OF THE COMMISSION January 1, 1981 No. 14 #80 -25 -C (2 -8) We have completed our investigation of the allegation that you violated Act 170 of 1978 by filing an incomplete Financial Interest Statement. We find that you did file an incomplete statement but have now corrected this filing. We also wish to note that there is still a question on the requirement for you to file. Appointed officials who receive no compensation except reimbursement for expenses are not "public officials" for the purposes of Act 170. If your Board has a resolution stating that the money you receive is reimbursement for expenses, you are not required to file a Financial Interest Statement. We would appreciate any past or current resolution on this question. If the money is considered compensation, according to your past or clarifying resolution, you should file a statement with the Zoning Hearing Board for the preceding year by May 1st of each year you hold office and one year after. All files in this case will remain confidential. This order will be final and become available as a public document within 20 days unless you file documentation which justifies pertinent factual changes. Sincerely yours, Paul J7 Smith Chairm n
