Dear Representative Berson:

By letter dated June 6, 1979, you requested an
opinion from the State Ethics Commission to determine whether
the Executive Director of the House Judiciary Committee could
also serve as a contractual consultant to the Sentencing Com-
mission.
This Sentencing Commission is an independent body
created by the General Assembly by Act 319 of 1978.
The Ethics Commission understands that the Judiciary
Committee Executive Director has no authority to take final
action in either his Executive Director or proposed consultant
capacity. Nor would he represent the Sentencing Commission before
the Judiciary Committee. It is our further understanding that
this arrangement will require clearance under the House Ethics
provisions.
It is the Commission's opinion that the "consultancy
arrangement" under the circumstances does not present a conflict
under Act 170.
