In your letter of January 30, 1979, you requested
an advisory opinion from the State Ethics Commission pursuant
to Section 7(9)(ii) of Act 170 of 1978 relative to your position
as an elected member of the Doylestown Borough Council. In
your letter you explained that your husband owned a truck fran-
chise and repair shop and that while most of his business is
with other governmental bodies, he occassionally does work for
the Borough of Doylestown.
It is the Commission's opinion that as an elected
member of the Doylestown Borough Council you are a "public
official" as that term is used in Act 170. Section 3(c) of
the Act prohibits a public official or "member of his immediate
family" from entering into "any contract valued at $500 or more
with a governmental body unless the contract has been awarded
through an open and public process. . ." If the Borough of
Doylestown desires to enter into a contract valued at $500 or
more with your husband, the Borough must comply with the public
notice and disclosure provisions of Section 3(c) of the Act. The
Commission advises you that Section 3(a) of the Act prohibits you
from using your public office to "obtain financial gain" for a
member of your immediate family. The Commission further advises
you that to comply with the spirit of Act 170, you must abstain
from all Council decisions concerning your husband's business.
This letter is a public record and will be made
available as such.
