In your letter of April 19, 1979, you requested an advisory
opinion from the State Ethics Commission pursuant to Section 7(9)(ii)
of Act 170 of 1978 relative to your position as member of the Board of
Directors of the Doylestown Hospital Authority. You explained that
you were appointed to the Board by the Council of the Borough of
Doylestown and serve without pay.

Act 170 applies to "public employees" and "public officials"
of the Commonwealth and political subdivisions thereof. The Act
specifically excludes "public officials" who are appointed to their
position and who receive "no compensation other than reimbursement for
actualy expenses." It is the Commission's opinion that as an appointed,
non - compensated member of the Board of Directors of the Doylestown
Hospital Authority you are not covered by the provisions of Act 170.
