July 9, 1979 79 -031 In your letter of January 22, 1979, you requested an advisory opinion from the State Ethics Commission concerning the application of Act 170 of 1978 to members of the Upper Makefield Township Planning Commission, the Upper Makefield Township Park and Recreation Board, and the Upper Makefield Township Historical Commission. You explained that the members of the above boards and commissions are appointed officials and receive no compensation for their services. Act 170 applies to "public officials" and "public employees" of the Commonwealth and political subdivisions thereof. The Act specifically excludes "public officials" who are appointed to the position and who receive no compensation other than reimbursement for actual expenses." It is the Commission's opinion that appointed non - compensated members of the Upper Makefield Township Planning Commission, the Upper Makefield Township Park and Recreation Board, and the Upper Makefield Township Historical Commission are not covered by the provisions of Act 170. This letter is a public record and will be made available as such. State Ethics Commission 308 Finance Building Harrisburg, PA 17120 (717) 783 -1610 Sincerly, J Paul J. 'mith Chairman
