July 9, 1979 In your letter of January 18, 1979, you requested the State Ethics Commission to furnish you an opinion pursuant to Section 7(9)(ii) of Act 170 of 1978 relative to your position as an elected School Director of the New Hope - Solebury School District. You explained that you are a sales representative for Ginn and Company, a supplier of school textbooks. You further explained that while Ginn sells books to the New Hope - Solebury School District, you do not call on the District in your capacity as sales representative for Ginn nor do you vote on matters that authorize the purchase of books from Ginn. You indicated that Ginn and Company sells textbooks in amounts in excess of $500.00 to various school districts within the State. As an elected school director, you are a "public official" as that term is used in Act 170. Section 3(a) of the Act provides that no "public official" shall use his public office "to obtain financial gain" for himself or a business with which he is associated. It is the Commission's opinion that Act 170 requires you to continue to abstain from participating in New Hope - Solebury School District matters affecting Ginn and Company. As you are not an owner, director, officer or holder of stock exceeding five percent of equity at fair value of Ginn and Company or its parent organiza- tion, Xerox Corporation, Ginn and Company may contract with the New Hope - Solebury School District and other school districts without regard to the notice and disclosure provisions of Section 3(c) of the Act.
