Dear Dr. Beck:
In your letter of January 22, 1979, youiequested the State
Ethics Commission to furnish you an opinion pursuant to Section 7(9)(ii)
of Act 170 of 1978 relative to your position as Administrator in the
New Hope - Solebury School District. You explained in your letter that
you were initially hired by the District in 1956 as a teacher, but
that since August 1977 you have been serving as an administrator in
the District. Your letter further explained that your wife has been
employed as a teacher in the District since 1967.
As a "public employee" under Act 1970, you are prohibited
by Section 3(a) of the Act from using your public office to "obtain
financial gain" for a member of your immediate family. It is the
Commission's opinion that Act 170 does not prohibit the simultaneous
employment of you and your wife by the New Hope - Solebury School
District. As a public employee, you are required to file a statement
of financial interests pursuant to Section 4 of the Act.
