In your letter of January 22, 1979, you requested the State
Ethics Commission to furnish you an opinion pursuant to Section 7(9)(ii)
of Act 170 of 1978 relative to your position as the appointed Business
Manager for the New Hope - Solebury School District. In your letter you
explained that in addition to serving as Business Manager for the School
District you also serve as Secretary to the Board of School Directors and
as Administrative Assistant for the New Hope - Solebury School Authority.
You reported that you receive an annual salary of $13,900 as Business
Manager for the District, $1,000 per year as Secretary to the Board, and
$200 per year as Administrative Assistant for the School Authority.
As Business Manager for the New Hope - Solebury School District,
it is the Commission's opinion that you are a "public employee" as that
term is used in the Act. Section 3(c) prohibits a public employee from
entering "into any contract valued at $500 or more with a governmental
body unless the contract has been awarded through an "open and public
process..." It is the Commission's opinion that Act 170 does not prohibit
you from simultaneously holding the three positions described above as
(1) your appointment as Board Secretary pre -dated the effective date of
Act 170, and (2) your annual salary as Administrative Assistant for the
School Authority is less than $500 per year. As a "public employee" you
are required to file a statement of financial interests pursuant to
Section 4 of the Act.
