In your letter of January 22, 1979, you requested the State
Ethics Commission to furnish you an opinion pursuant to Section 7(9)(ii)
of Act 170 of 1978 relative to your positions as an elected School Director
of the New Hope - Solebury School District and as an appointed member of the
New Hope Borough Police Department. In your letter you explained that you
began serving as a School Director in December of 1977 and in June 1978 be-
gan your duties as a member of the Borough Police Department at an annual
salary in excess of $500 per year. Your letter further explained that your
husband has been employed by the New Hope Borough as a police officer since
October of 1973.
As an elected member of the Board of Directors of the New Hope -
Solebury School District, you are a "public official" as that term is used
in Act 170. As a "public official ", you are prohibited by Section 3(c) of
the Act from entering "into any contract valued at $500 or more with a
governmental body unless the contract has been awarded through an open
and public process.... It is the Commission's opinion that inasmuch as
you were appointed to your position as a member of the New Hope Borough
Police Department through "an open and public process ", Act 170 does not
prohibit you from holding both positions. As a "public official ", you are
required to file a statement of financial interest pursuant to Section 4
of the Act.
This letter is a public record and will be made available as such.
