Dear Ms. Dissinger:
STATE ETHICS COMMISSION

In your letter of January 19, 1979, you requested the State
Ethics Commission to furnish you an opinion pursuant to Section 7(9)(ii)
of Act 170 of 1978 relative to your positions as an ! elected member of
the Board of Supervisors of Upper Makefield Townshipand Secretary/
Treasurer of the Board of Supervisors. In your letter you explained
that you were appointed to the position of Secretary /Treasurer at a
public meeting of the Board of Supervisors. As noted in your letter,
the Second Class Township Code expressly permits the appointment of a
mbmer of the Board of Supervisors to the position of Secretary /Treasurer.
Act of May 1, 1933, P.L. 103 art. V, Sec. 511, as amended, 53 P.S.
Section 65511.
As a "public official", you are prohibited by Section 3(c) of
the Act from entering "into any contract valued at $500 or more with a
governmental body unless the contract has been awarded through an open
and public process- It is the Commission's opinion that inasmuch as
you were appointed to the position of Secretary /Treasurer through "an
open and public process ", Act 170 does not prohibit you from holding
both positions and receiving compensation for the positions as authorized
by law. As a "public official ", you are required to file a statement of
financial interests pursuant to Section 4 of the Act.
Act 170 does not apply to your husband's employment as a part -
time consultant for the State of New Jersey.
