I am writing in response to your letter of February 16,
1979, concerning Representative Matthew J. Ryan. I have reviewed
Mr. Ryan's letter to you of February 16, 1979, in which Mr. Ryan
indicates that it is possible for him to obtain certain information
from the Banking Department relative to the salaries of officials
at Security Savings with which you are associated. Please be
advised that the State Ethics Commission does not have jurisdiction
concerning such a matter. The duties and powers of the Commission
are narrowly proscribed by Act 170 of 1978. The purpose of the
Act is to "assure that the financial interests of holders of or
candidates for public office present neither a conflict nor the
appearance of a conflict with the public trust ". Because your
letter does not raise a question concerning a conflict of interest,
the Commission is without authority to act.
If you are of the opinion that this is a proper matter
for the Commission, you may file a formal sworn complaint with the
Commission pursuant to Section 8 of the Act thereby requiring the
Commission to conduct an investigation into the matter.
