May 31, 1979 79 - 012 In your letter of December 29, 1978, you requested advice from the State Ethics Commission concerning the application of Act 170 of 1978 to your position as elected Mayor of Oil City. In your letter you explained that in addition to serving as Mayor, you are the principal owner of a general independent insurance agency that handles insurance accounts for several governmental entities outside the City of Oil City. You stated that premiums in most cases exceeded $500.00. Section 3(c) of Act 170 prohibits a public official or a business with which he is associated where he is a director, officer or owner from entering into a "contract valued at $500 or more with a governmental body unless the contract has been awarded through an open and public process..." It is the Commission's opinion that Section 3(c) is a limitation on a public official's ability to contract with the governmental body with which he is associated. Because the insurance contracts in question are with governmental bodies other than Oil City, it is the Commission's opinion that Section 3(c) does not prohibit you from entering into such contracts. as such.
